Defendants are resentenced on probation/parole violations

Several defendants that were previously sentenced by Carbon County court judges to either probationary are jail terms have had petitions filed by the adult probation office to revoke them from their current status.

The following actions were filed during May.Paul Tyahla, 26, of Palmerton, had a petition to revoke his probation filed by Kimberly Cooper of the probation office. On Jan. 14 he was sentenced by Judge Joseph J. Matika on a charge of providing false information on firearm ownership to 36 months probation.He violated conditions of the probation by failing to submit a urine screen on required dates and violated condition of zero tolerance for missed urine scene.Tyahla waived hearings on the petition and Matika revoked his probation and resentenced him to serve 30 days to one day less 24 months in the county prison. The jail term was effective on April 10.Keith Weaver, 53, of Palmerton, had a petition for revocation filed aganist him by Cooper. He was sentenced by President Judge Roger N. Nanovic on a possession of drug paraphernalia charge to serve six months probation. He violated probation by being arrested by Palmerton police for another possession of paraphernalia charge.He waived his right to hearings and was revoked. He was resentenced to serve 54 to 108 days in the county prison and will serve the full 108 days. The term began April 2.Ashley Roberts, 28, of Lansford, had a petition for revocation of probation/parole filed by Cooper for violating the following conditions: failed to report to the probation office as directed; was arrested by Rush Township police in Schuylkill County; failed to submit a urine screen; and failed to schedule a drug and alcohol evaluation as directed.She was sentenced by Nanovic on a charges of criminal use of a communication facility, defiant trespass to serve three to 18 months in jail and two yaers probation consecutive and one year probation consecutive.Her probation was revoked and was resentenced to serve six to 12 months in jail, which is effective from March 18; on a second case resentenced to serve six to 18 months, effective March 18, followed by one year probation consecutive; on a third case six to 12 months in jail, effective March 18, and concurrrent.Adam Berger, 20, of Bowmanstown, had a petition to revoke parole filed by Cooper for violating conditions of testing positive for drugs; failed to comply with D&A treatment; and violated zero tolerance provision.He was revoked from parole by Matika and remanded to the county prison to serve out his maximum, which runs to Nov. 8.Raymond Deluna, 42, of Palmerton, had a petition to revoke parole filed by Cooper for violating conditions of failing to submit to urine screen; and violating zero tolerance.His parole was revoked by Matika and he was remanded to the county prison to serve 30 days effective May 6.Christopher Schaeffer, 40, of Palmerton,had a petition to revoke parole filed by Cooper for violating conditions of testing positive for drugs; and violating zero tolerance.He was revoked from parole by Matika and remanded to the county prison to serve out his maximum turn which runs to June 21.William Pizzolo, 26, of Kunkletown, had his probation revoked on petition filed by probation officer Joseph Burke on a possession of drug charge, and was resentenced by Nanovic to serve five to 10 months in the county prison effective March 1.Brett Docken, 33, of La Quinta, Calif., had a petition to revoke parole filed by Burke on a charge of driving under the influence (DUI).He was revoked by Judge Steven R. Serfass and was remanded to the county prison to serve out his maximum which runs to Nov. 9.Jennifer Rudelitch, 36, of Palmerton, had her sentence amended additional violations including being arrested by Lehighton police. Serfass resentenced her to serve six months in prison effective Feb. 7 followed by two years of probation.Carlos Delgado, 30, of Lehighton, had a petition to revoke bail filed by Cooper for violating the conditions by having contact with the victim and failed to report for pretrial services as ordered within 48 hours of his release from jail.His unsecured bail was revoked by Serfass and new bail was set at $15,000 straight cash. Delgado was unable to post bail and was remanded to the county prison.
