Woman admits to part in drug lab; man pleads in five cases

A Carbon County woman was sentenced to a prison term on Tuesday in the county court after pleading guilty to a drug count, while a county male got prison time after entering pleas in five pending cases.

The two were among 25 to enter pleas in pending criminal cases before Judge Joseph J. Matika.Meth labPearl C. Cullen, 37, of Summit Hill, pleaded to one count of criminal conspiracy to manufacturer a controlled substance-methamphetamine.She was arrested by agents of the state Attorney General's office and the county drug task force with operating a meth laboratory at her resident at 428 W. Iron St.During the search of the home on Feb. 6, evidence was found that Richard Earl George Jr., 40; and Cullen, were manufacturing methamphetamine in the residence. Evidence included a plastic zip-locked bag of suspected methamphetamine; three partially melted plastic soda bottles containing suspected meth residue; and two cans of Coleman camping fuel.Matika sentenced her to serve four to 23 1/2 months in the county prison with credit for 34 days.She was also ordered to get both a drug and alcohol (D&A) and mental health evaluations and follow any recommendations for treatment, zero tolerance imposed on D&A use, render 100 hours of community service when released on parole, and supply a DNA sample.George was also scheduled to plea guilty Tuesday to his part in the incident but his case was continued.Five casesMatthew D. Frederick, 19, of Palmerton, pleaded guilty in five pending cases to charges of criminal conspiracy-theft, aggravated assault, possession of marijuana, criminal trespass, and theft from a motor vehicle.He was arrested by Palmerton police on the various theft counts for entries made to numerous vehicles in the borough during a time frame of December 2011 into February 2012. The assault count involved an incident on Jan. 22, 2012, in which he assaulted Arron Bizousky along Delaware Avenue.Frederick was recently sentenced to serve one to one day less 24 months in a terroristic threats charge and is in the county prison.Matika deferred sentencing to a later date.Other casesOther defendants who entered pleas included:Victor Alfredo Mateo, 24, of Hazleton, pleaded to one count of driving under the influence (DUI) of a controlled substance. He was arrested on Oct. 25, 2012, along Laurel St., by Weatherly police.Sentencing was deferred to give Mateo a chance to apply for placement in the county's Intermediate Punishment Program (IPP) with electronic monitoring.Dylan R. Bertuola, 25 of McAdoo, pleaded to one count of DUI of alcohol. He was arrested on Dec. 1, 2012, along Market St., by Nesquehoning police. Given a test, the result was .20BAC.Matika sentenced him to serve five days to six months in jail, a fine of $300, one year license suspension, get a D&A evaluation, zero tolerance on D&A use, and render 25 hours of community service.He will serve the prison term beginning on March 24 at 8 a.m.Troy Michael Fairchild Sr., 40, of Coaldale, pleaded to one count of receiving stolen property. He was arrested by state police at Lehighton, for incidents at the Country Junction store in Towamensing Township.He made purchases on the account of another person without their permission.Fairchild is currently in prison serving a six to 23 month term on unrelated charges. Sentencing was deferred.Michael David Rudd, 28, of Avondale, Chester County, pleaded to one count of DUI of alcohol. He was arrested on July 22, 2012, along SR940 by Kidder Township police. Given a test, the result was .09BAC.A first offense, Matika placed him on probation for six months and ordered he pay a fine of $300, get a D&A evaluation, zero tolerance on D&A use, and render 25 hours of community service.Michael Joseph Keen, 46, of Bear Creek Lakes, pleaded to one count each of simple assault, and a summary offense of public drunkenness. He was arrested on Jan. 6 by Kidder Township police for an incident at the Pine Point Plaza, along SR903. He was found lying around the road and when police attempted to place him under arrest he swung at and hit Officer David Mason.On the assault charge Matika sentenced him to serve two to 12 months in jail, get a D&A evaluation, and render 50 hours of community service. On the summary offense he was fined $100 and costs.He was given credit for 65 days spent in jail on the charges and was immediately paroled.Eric Michael Anderson, 34, of Philadelphia, pleaded to one count of DUI of alcohol. He was arrested on Aug. 15, 2012, along Wolfhollow Rd., by Kidder Township police. Given a test, the result was .17BAC.Matika placed him on probation for six months, and ordered he pay a fine of $300, get a D&A evaluation, zero tolerance on D&A use, and render 25 hours of community service.Ricky Alex Williams, 22, of Nesquehoning, pleaded to one count of receiving stolen property. He was arrested on Sept. 1, 2011, by Nesquehoning police for stealing a diamond ring from his grandmother and then pawning it in Lehighton.Williams is currently serving a probation violation prison term in Lehigh County, which runs until the end of August.Matika placed him on probation for a year and ordered he render 50 hours community service when released from prison. The term runs consecutive to the Lehigh County sentence.Daniel J. O'Donnell, 41, of Summit Hill, pleaded to one count of harassment, as a misdemeanor three. He was charged by Nesquehoning police for an incident at the county prison where he threatened corrections officers and the warden, Joseph Gross. A threats charge was dropped in a plea bargain.Matika sentenced him to serve three to six months in prison and get a mental health evaluation. The term runs concurrent with a prison sentence he is currently serving.Rex A. Benner, 52, of Lehighton, pleaded two counts of DUI of alcohol in two separate incidents and a charge of accidents involving unattended vehicle.He was arrested on the first count on July 22, 2012, along Forest Inn Road in Lower Towamensing Township, by state police at Lehighton. Given a test, the result was .20BAC.After he was released in the first case and taken home, he drove his motorcycle and was involved in a crash early on July 23 along Fireline Road, in Lower Towamensing Township. State police arrested him a second time and a test revealed a .12BAC.On both counts he was sentenced to serve 48 hours to six months in jail with the terms running consecutively. He was fined a total of $1,000, two years of license suspensions, get a D&A evaluation, zero tolerance on D&A use, and render a total of 50 hours of community service while on parole.He will begin the first jail term on March 15 at 9 a.m. and the second on March 22, at 9 a.m.Robert Charles Ahn III, 33, of Summit Hill, pleaded to one count of possession with intent to deliver a controlled substance-heroin. He was arrested by agents of the AG officer after selling heroin to agents on at least three occasions in Lansford or Summit Hill.Matika deferred sentencing and ordered the adult probation office to prepare a presentence investigation (PSI).Deborah Gay Brown, 52, of Perkasie, Bucks County, pleaded to one count of retail theft. She was arrested on Jan. 1, 2012, at Redners Warehouse Market by Nesquehoning police, for taking items valued at $9.84.It was noted she has four prior retail theft convictions.Matika deferred sentencing.Mark Daniel Geary, 32, of Lehighton, pleaded to one count each of DUI of alcohol, and accidents involving damage to unattended vehicle, a summary offense. He was arrested on July 15, 2012, by Palmerton police along SR248 after being involved in an accident. Given a test, the result was .17BAC.Matika sentenced him to serve 48 hours to six months in jail, a fine of $500, one year license suspension, get a D&A evaluation, and zero tolerance on D&A use.On the summary charge he was fined $200 and costs.He begins the jail term at 9 a.m. on March 22.John Charles Sabol, 49, of Lansford, pleaded to two counts of possession with intent to deliver a controlled substance-heroin, in two pending cases.He was arrested on June 7, 2011, by state police narcotics unit for selling heroin to a confidential informant (CI) near his residence. The second count was filed by Lansford police for a sale at his residence to a CI.Matika deferred sentencing and ordered a PSI.Anthony Phillip Borrelli, 26, of Scranton, formerly of Palmerton, pleaded to one count of possession of drug paraphernalia. He was arrested by state police at Lehighton on May 27, 2012, when they went to a residence in Bowmanstown to serve a warrant for another individual.Matika placed him on probation for six months, consecutive a probation violation term he is currently serving. He was also ordered to get a D&A evaluation, zero tolerance imposed on D&A use, and render 25 hours of community service.Nicholas Frank Carino, 24, of Lehighton, pleaded to one count of simple assault. He was arrested on July 27, 2012, by Palmerton police for an incident along Delaware Avenue where he assaulted Ronald Reitz Jr., of Palmerton.Matika placed him on probation for a year and ordered to continue is mental health counseling, have no contact with Reitz, and render 50 hours of community service.John A. Vanhorn Jr., 25, of Easton, pleaded to one count of DUI. He was arrested on Oct. 6, 2012, by Summit Hill police along Oak St. Given a test, the result was .16BAC.Matika sentenced him to serve five days to six months in jail, pay a fine of $300, one year license suspension, get a D&A evaluation, zero tolerance on D&A use, and render 25 hours of community service.He began the jail term immediately.Timothy J. Willman , 27, of Pine Grove, pleaded to one count of resisting arrest. He was arrested on Nov. 22, 2012, by Nesquehoning police for a incident in the area of 127 W. Columbus Ave.Matika deferred sentencing and ordered a PSI.William Daniel McHose, 30, of Nesquehoning, pleaded to one count of possession of drug paraphernalia. He was arrested on Nov. 7, 2012, at his residence.Matika placed him on probation for six months and ordered to get a D&A evaluation, zero tolerance on D&A use, and render 25 hours of community service.Kody A. Christman, 21, of Albrightsville, pleaded to one count of retail theft. He was arrested on Dec. 4, 2012, by Kidder Township police for an incident at the Square One Exxon station. He was an employee there and was charged with stealing lottery tickets and food from the station.Matika placed him on probation for a year and ordered he make restitution of $155.68 to the victim, stay off the Exxon property, and render 50 hours of community service.James M. Duffy, 34, of Beaver Meadows, pleaded to one count of DUI. He was arrested on Sept. 15, 2012, along Main St., by Weatherly police after being involved in an accident. Given a test, the result was .25BAC.Sentencing was deferred so Duffy could apply for placement in the IPP with electronic monitoring.Holly Kuneck, 63, of Palmerton, pleaded to one count of bad check. She was arrested by Palmerton police for issuing a check for borough services in the amount of $335.82 and it was returned for insufficient funds.She was previously placed in the county's Accelerated Rehabilitation Disposition (ARD) probation program for first time offenders but was revoked from it for failure to keep in touch with probation department.Matika placed her on probation for six months and ordered her to render 30 hours of community service. Restitution has already by made to the borough.Todd Matthew Miller, 19, of Weatherly, pleaded to one count of possession of drug paraphernalia. He was arrested on Nov. 7, 2012, by Weatherly police along Hudsondale St.He was placed on probation for six months and ordered to render 25 hours of community service.Brad A. Sharwell, 51, of Albrightsville, pleaded to one count of theft of services. He was arrested by Kidder Township police on information supplied by PPL. The electric company claimed he received electrical service by tampering with a meter after the service had been cut off to his residence for nonpayment of a bill.Matika placed him on probation for a year and ordered he make restitution of $525.83 to PPL, and render 50 hours of community service.SentencedRussell D. Evans, 30, of White Haven, who previously pleaded guilty to a DUI charge, was sentenced to serve one to two years in the county prison. He was arrested on April 7, 2012, by state police at Fern Ridge along Interstate 80 in Kidder Township. Given a test, the result was .26BAC.He was also ordered to pay a fine of $2,500, 18 month license suspension, get a D&A evaluation, zero tolerance on D&A use, and when released on parole render 100 hours of community service.He was given credit for 28 days spent in a inpatient rehab program. He began the jail term immediately.Each defendant sentenced must pay court costs, which average close to $1,000, and pay a $50 per month supervision fee while on probation or parole.
