A Carbon County man was sentenced to a state jail term Thursday after previously pleading guilty to a drug charge. He was one of six who had entered guilty pleas and were sentenced by Judge Joseph J. Matika.

State termVincent Keller, 28, of Weissport, was sentenced to serve a total of 15 to 36 months in a state prison on a charge of criminal attempt-possession with intent to deliver a controlled substance and nine to 18 months on a charge of depositing chemical waste along a road.Keller was arrested on the possession count on April 3, 2012, by agents of the state Attorney General's office for an incident in the 100 block of S. Second St., Lehighton.The depositing count stems from an April 1, 2021, incident where he threw garbage bags of chemicals along SR902 in Summit Hill.Keller is currently serving a 1 to two year state sentence on unrelated charges imposed by Schuylkill County court.He got a break when Matika ruled the new sentence would run concurrent with the one in Schuylkill.Keller was also ordered to get both a drug and alcohol (D&A) and mental health evaluations and follow any recommendations for treatment, zero tolerance imposed on D&A, and render 100 hours of community service when released on parole.Heroin addictionJosh D. Gutosky, 28, of Weatherly, was sentenced to serve nine to 23 1/2 months in the county prison on four counts of possession with intent to deliver a controlled substance-heroin.Gutosky admitted at the time of his guilty plea to a serious heroin addition problem. He was arrested on Jan. 21, 2012, in the area of 318 Plane St., by Weatherly police.Since his arrest Gutosky spent seven and a half months in a inpatient rehabilitation program and continues counseling.Matika also ordered him to render 100 hours of community service, zero tolerance imposed on D&A use, and supply a DNA sample.Gutosky was given credit for 196 days spent in rehab and 43 spent in jail on the charge for a total of 239, and was immediately paroled.Other casesOther defendants sentenced by Matika included:Christopher Lee Albertson, 32, of Freeland, Luzerne County, was placed on probation for a year on two counts of recklessly endangering another person, and one count of escape.He was arrested on by Weatherly police for an incident on Feb. 16, 2012, along First St. where police said he had two, two-year-old children, in the backseat of his vehicle not in safety seats. When police arrived he fled the scene leaving the children alone in the vehicle.Albertson told the court after his arrest he entered a inpatient rehab program and continues outpatient counseling. He spent 24 days in the rehab and 23 days in prison on the charges.Matika also ordered him to get a D&A evaluation, zero tolerance on D&A use, and render 50 hours of community service.John Albert Britton Jr., 60, of Leesport, Berks County, was sentenced to serve 90 days to five years in the county prison on a charge of driving under the influence (DUI). He was arrested on on June 9, 2012, along Patterson St., by Lansford police. He refused a blood test.Matika also ordered him to get a D&A evaluation, zero tolerance imposed on D&A use, fined $1,500, and license suspended for 18 months.On a summary charge of driving without a license he was fined $200.Britton is currently serving a 60 day jail term in Berks County on a charge of driving under suspension-DUI related. Matika gave him a break and ordered the new sentence run concurrent with the Berks term.David Terry Pasternak, 43, of Palmerton, was sentenced to serve five days to six months in jail on a DUI charge. He was arrested on Aug. 16, 2012, along SR248 in Palmerton, by state police at Lehighton. Given a test, the result was .10BAC.Zero tolerance was imposed on D&A use, and he was ordered to render 25 hours of community service.He will begin the jail term on March 29 at 6 p.m. and serve it on consecutive two, two and one day weekends.Barry L. Schlier, 31, of Lansford, was placed on probation for a year on a charge of receiving stolen property. He was arrested by Lansford police for an incident on April 2 when he was charged with removing a washer and dryer from 343 W. Abbott St., where he was renting but was evicted.He was also ordered to render 50 hours of community service.Guilty pleasTwo defendants in pending cases entered guilty pleas Thursday.Catherine Carmella Capece, 37, of Hammonton, N.J., and formerly of Lansford, pleaded to one count of theft. She admitted taking money from a purse at the Lansford Library on July 8, 2011. The money was returned the same day.Matika placed her on probation for six months and ordered she have no contact with the victim, Patricia Ladick.Jeffrey Lee Panovec, 63, of Kunkletown, pleaded to one count of DUI. He was arrested on July 21, 2012, along Cherry Hill Road, by Franklin Township police. Given a test, the result was .19BAC.Matika placed him on probation for six months, pay a fine of $300, get a D&A evaluation, zero tolerance on D&A use, and render 25 hours of community service. The term runs consecutive to term he is currently serving on a prior DUI.Each defendant must also pay court costs, which average about $1,000, and pay a $50 per month supervision fee while on probation or parole.
