Loses appeal

Kasa Delana Brennan, 28, Shenandoah, who was found guilty of delivery of illegal drugs in Shenandoah and was sentenced on July 20, 2012 by Judge Jacqueline Russell to a one to two year stretch in a state prison, lost her appeal in the Pennsylvania Superior Court to have the sentence set aside. She based her claim that the evidence was not sufficient to support a conviction based upon constructive possession of the drugs.

At the trial, Barbara Rainis, operator of a tanning facility known as Florida Tanning Salon in Shenandoah Heights, testified she found a package in one of the tanning rooms containing plastic bags of cocaine and a security camera revealed Brennan was occupant of the room and as she left the bags dropped to the floor. Brennan later returned to the salon claiming she lost a $20 bill and searched the property.

The high court disagreed with Brennan's claim pointing out the law defines constructive possession as an inference arising from a set of facts that possession of the contraband was more likely than not. The court ruled the evidence showed she dropped the cocaine upon leaving the tanning room and denied her appeal.
