A habitual offender of the state's motor vehicle code, who has 35 prior convictions, was allowed by a Schuylkill County Judge to celebrate Christmas but must report to the county prison the day after Christmas to begin serving a 60 days sentence.

Gerald J. Biscoe, 33,of 134 North Kennedy Drive, Rear, McAdoo, last May 3 was found guilty By Magisterial District Justice Stephen Bayer, Tamaqua, of driving while his operating privileges were suspended and was sentenced to serve 60 days in the county prison, pay a fine of $1,000, plus court costs of $86. Biscoe filed an appeal to the county court appealing the conviction.The appeal was scheduled before Judge Cyrus Palmer Dolbin, however, Biscoe failed to appear for the hearing. District Attorney Karen Byrnes Noon then made a motion to dismiss the appeal which was granted by the judge who then issued an order for Biscoe to report to the county prison on Wednesday, December 26 at 9 a.m. to begin serving the 60 days sentence.
