4 from area plead guilty to criminal charges

Four area people were among 30 who pleaded guilty to criminal charges and were sentenced by Judge Charles M. Miller in the Schuylkill County Court.

Jennifer Lee Dipietro, 29, of 230 Green Streeet, Apartmernt Two, Tamaqua, theft by unlawful taking jewelry, was given credit for serving 42 days in the Schuylkill County Prison and was released on parole for 23 months, pay $50 to CJEA (Criminal Justice Enhancement Account) fund, a $50 monthly fee for each month on parole and make restitution of $3,300 to the victim, Wisam Abazly,. Dipietro was cited by Corporal Dwayne Hacker, Tamaqua Police, on December 23, 2011.Samantha Jean Digilio, 20, of 518 Lombard Street, Tamaqua, failing to furnish drug free test to probation officer, placed on probation 12 months, pay $50 to CJEA fund and a pay a $50 monthly fee for each month on probation. She was cited by Sargent John R., Morrow, Pottsville Police, last March 9.Charles Thatcher, 42, of 5 East High Street,Coaldale, resisting arrest, placed on probation 23 months, pay $50 to CJEA fund, and a $50 monthly probation fee. On a charge of criminal mischief by damaging eye glasses a juvenile from Summit Hill following an altercation last April 5 at Sixth and High Streets, was fined $25. Thatcher was cited by Patrolman Joseph Krebs, Coaldale Police.Victor Barry Craig, 35, of 27 West Grant Street, McAdoo, 35. of 27 West Grant Street, McAdoo, simple assault, placed on probation 15 months, pay $50 to CJEA fund, a $50 monthly probation fee and make restitution of $416.05 to Kristel Gartner, Sheridan Street. On a charge of criminal mischief was fined $25. Craig was cited by Patrolman Anthony Divirgillo, McAdoo Police.Arthur Lee Price, 54, Wilkes-Barre, criminal conspiracy to committ retail theft at Walmart Store in Rush Township, sentenced to serve two moinths to 23 months in the county prison with credit for serving 51 days, pay $50 to CJEA fund, a $50 monthly probation fee and make restittion of $694.55 for theft of five television sets last July 23. Price was cited by Patrolman Bradley Hess, Rush Township Polce.Trevor Michael Carl, 22, Minersville, theft, placed on probation 18 months, pay $50 to CJEA fund and pay a $50 monthly probation fee. Carl was cited by Patrolman Eugene M. Yourey, Pottsville Police, last May 12.Richard L. Himmelberger, 44, Pottsville, on two counts of delivery of a controlled substance was sentenced to serve 11 1/2 months to 23 months in the Schuylkill County Prison with the sentence to begin Wednesday, January 2 at 9 a.m., pay $200 to SAE (Substance Abuse Education) fund, $100 to CJEA fund, $113 to the Bethlehem Regional Lab, $50 to Pottsville Police Drug Task Force and were released on probation to pay a $50 monthly fee.Mark Andrew Leib, 20, Schuylkill Haven, on two counts of possession of drug paraphernalia was placed on probation 23 months, pay fines totaling $200, pay $100 to CJEA fund and a $50 monthly probation fee. Leib was cited by Schuylkill Haven and Orwigsburg Police last Spring.William Frederick Nichols, III, 31, Schuylkill Haven, possession of drug paraphernia and a small amount of marijuana was given credit for serving 44 days in the county prison and was placed on paroled for 12 months, pay $100 to SAE fund, $50 to CJEA fund and a $50 monthly probation fee and on a charge of harassment was fined $25. Nichols was cited by Patrolman William I. Horn, Schuykill Haven Police last January 15.Steven Thomas Rhoades, 22, Schuylkill Haven, retail theft, sentenced to serve one month to 23 months in the county prison beginning Friday, January 4 at 9 .m., pay $50 to CJEA fund, a $50 monthly probation fee and make restitution of $60 to Giant Food Store, Cressona Mall. He was cited by Trooper John B. Carr on October 29, 2011.Leon Allen Schappell, III, 22, Orwigsburg, simple assault on his mother, Kimberly Berger, which occurred in a public parking lot, placed on probation 12 months, pay $50 to CJEA fund and a $50 monthly probation fee. Schappell was cited by Patrolman Brandon K. Bayer, Orwigsburg Police, last May 8.Joshua Brandon Dail, 26, Abingdon, Maryland, theft of mail parcels, placed on probation 12 months, pay $50 CJEA fund, a $50 monthly probation fee and make restitution of $1,813.17 to Michael Mazzca, owner of Mazzuca Enterprises, Pottsville. Dail was cited by Patrolman Joseph H. Murton, Jr., Pottsville Police, on October 14, 2011.Sent to state prisonGirard Philip Grahanm, 22, Hazleton, failing to have a license for a pistol found in his possession, was sentenced to serve one year to two years in a state correctional institution and received credit for serving 163 days in the county prison. He also must pay $50 to CJEA fund. Graham was cited by Patrolman William Curilla, McAdoo Police, last July 2.Andre W. Hewitt, 37, Reading, Berks County, dui of alcohol, serve 48 hours to six months in the county prison, fined $500, pay $100 to SAE fund, $50 to CJEA fund, $50 to Catastrophe fund, complete safety school, receive outpatient substance abuse treatment and driver's license suspended 12 months. Hewitt was cited by Patrolman Thomas Rodgers, Tamaqua Police, when stopped on April 7, 2011 in 300 block of North Railroad Street.Tiffany M. Jadus, 23, Shenandoah, theft of currency and drugs, was given credit for serving 28 days in prison and was released on parole for 23 months, pay $50 to CJEA fund, a $50 monthly probation fee and make restitution of $248 to Philip Alcarez, Saint Clair. Jadus was cited by Patrolman Kirk Kirkland, Shenandoah Police, on August 4, 2011.Tobi A. Metz, 30, Schuylkill Haven, possession of drug paraphernalia, 12 months probation, pay $100 to SAE fund , $50 to CJEA fund, a $50 monthly probation fee, undergo a drug evaluation and perform 10 hours community service. Metz was cited by Patrolman Gregory S. Meisner, Schuylkill Haven Police, last April 25.Timothy Mark Scott, 43, Pottsville, possession of a controlled substance, sentenced to serve three months to 23 months in the county prison beginniung Wednesday, January 2, 2013 at 9 a.m., pay $50 to CJEA fund, and when released on probation pay a $50 monthly probation fee, perform 25 hours of community service and make restitution of $40 to Kenneth Lucas, of North Fourth Street for theft of his Wii game. Scott was cited by Patrolman Joseph H. Murton, Jr., Pottsville Police, last April 24.Peter Nathan Clive, 39, Saint Clair, dui of alcohol, sentenced to serve 72 hours to six months in the county prison, fined $1,000, pay $300 to SAE fund, $50 to CJEA fund, $50 to Catastrophe fund, $60 to SMC, a $50 monthly probation fee, complete safety school, complete 10 hours of community service and driver's license suspended 12 months. Clive was cited by Sargent Willliam Dewald, Pottsville Police, on November 10, 2010. He previously was placed in the ARD (Accelerated Rehabilative Dispositon) Program but it was revoked when he broke the rules.David Leonard Heinly, 54, Pottsville, dui of alcohol, sentenced to serve 90 days to five years in the county prison beginning Thursday, December 27 at 9 a.m., fined $1,500, pay $300 to SAE fund, $50 to CJEA fund, $50 to Catastrophe fund, a $50 monthly probation fee, complete safety school, receive intensive outpatient substance abuse treatment and perform 40 hours of community service. Heinly was cited by Patrolman Renee R. Galle, Pottsville Police, last June 5.Broc James Himmelberger, 26, Schuylkill Haven, dui of alcohol, sentenced to serve 72 hours to six months in the county prison beginning Friday, January 4, 2013 at 9 a.m., fined $1,000, pay $300 to SAE fund, $50 to CJEA fund, $50 to Catastrophe fund, $60 to SMC, a $50 monthly probation fee, complete safety school, receive outpatient substance abuse counseling, perform10 hours community service and driver's license suspended 12 months. On summary charges of failing to obey a traffic light and failing to drive on roadway laned for traffic was fined $50 plus $100 costs. Himmelberger was cited by Trooper David F. Beam last February 12 when stopped on University Drive in North Union Township.Andrew Daniel Smeltz, 35, Summerdale, possession of an instrument of crime, sentenced to serve two months to 23 months in the county jail with the sentence to begin Thursday, December 27 at 9 a.m., fined $100, pay $50 to CJEA fund and a $50 monthly probation fee. He is eligible to participate in a work release program while in prison. On a charge of propulsion of a missile into an occupied vehicle received a prison sentence of one months to 23 months to run concurrent with the other sentence and on a charge of harassment was fined $25 plus $50 costs. When released on probation he shall enroll in Anger Management Program and must forfeit the weapon involved. Smeltz was cited by Trooper Tom Knock on November 25, 2011 and the incident occurred on Kushwa Road in Hubley Township.Jason R. Firing, Schuylkill Haven Police, on August 6, 2011.Erica Jean Ebling, 52, Pottsville, possession of a controlled substance, was given credit for spending four days in the county prision and was released on parole for 12 months, pay $100 to SAE fund, $50 to CJEA fund, a $50 monthly probation fee and make restitution of $113 to the Bethlehem Regional Lab. Ebling was cited by Schuylkill County Drug Task Force on September 12, 2011.Joseph James Fogarty, 44, Lost Creek Village, West Mahanoy Township, possession of an instrument of crime (loaded shotgun), was given credit for serving 49 days in the county prison and released and placed on parole for 23 months, pay $50 to CJEA fund and a $50 monthly probation fee. Fogarty was cited by Chief Michelle Ashman, Frackville Police, last February 11.Richard Lee Griffiths, 49, Minersville, delivery of a controlled substance, sentenced to serve six months to 23 months in the county prison with credit for serving 22 days with the sentence to commence on Wednesday, January 2, 2013 at 9 a.m., pay $100 to SAE fund $50 to CJEA fund, a $50 monthly probation fee and make restitution of $113 to Bethlehem Regional Lab. Griffiths was cited by Patrolman Jeffrey R. Bowers, Minersville Police on August 24, 2011.Denise M. Krammes, 43, Shenandoah, two counts of delivery of a controllled substance, sentenced to serve two months to 23 months in the county prison with the sentence to begin Monday, January 7, 2013 at 9 a.m., fined $400, pay $100 to SAE fund, $50 to CJEA fund, a $50 monthly probation fee and make restitution of $226 to Bethlehem Regional Lab and $100 to Schuylkill County Drug Task Force which cited her on September 13, 2011 at her residence.Jennifer Lynn Ost, 35, Pottsville, criminal mischief to vehicles, placed on probation 23 months, pay $50 to CJEA fund, a $50 monthly probation feer and make restitution of $2,242.02 to Brian Gountis, $159.76 to Paul Meyers, $2,473.48 to State Farm Insurance Company for car damages and $138 to Market Square, Ltd., Pottsville, for items removed from a storage closet in its apartment building. Ost was cited by Patrolman Paul R. Olson, Pottsville, last May 14. Peel was cited by Patrolman Charles Kovalewski, Mahanoy City Police, on October 10, 2011.Stephen Walter Jaskierski, 49, Frackville, dui of alcohol, sentenced to serve 72 hours to six months in the county prison with the sentence to begin on Friday, Jab uary 4, at 9 a.m., fined $1,000, pay $300 to SAE fund, $50 to CJEA fund, $50 to Catastrophe fund, a $50 monthly probation fee, complete safety school and receive outpatient substance abuse treatment, perform 10 hours community service and driver's license suspended 12 months. He was citedby Trooper Mark Demko last New Year's Day when stopped on Route 61 in New Castle Township.Christopher Matthew Williams, 32, Pottsville, dui of alcohol, placed in Intermediate Punishment Program to serve six months on probation, fined $300, pay $100 to SAE fund, $50 to CJEA fund, $50 to Catastrophe fund, $60 to SMC, a $50 monthly probation fee, complete safety school, and athere is no license suspension. Williams was cited by Patrolman Jason A. Klouser, Minersville Police, last May 20.
