Jury awards $5,000 in car crash

A Frackville chiropractor was awarded $5,000 in damages by a jury for injuries he suffered when his car collided with a car driven by a Tamaqua man on Dec. 21, 2007, in the parking area of the Schuylkill Mall. Marlin Weyant, of 62 Mahanoy St., Tamaqua, was the driver of the other vehicle.

Dr. Richard T. Adams Jr., 246 S. Lehigh Avenue, testified he was operating his vehicle in a lawful manner in the parking lot of the mall when Weyant pulled out of the parking space in front of him in an abrupt fashion that he could not stop and a collision occurred.Most of the case was about the injuries the doctor suffered as Weyant did not deny being involved in the accident, however, there was a disagreement as to the extend of the injuries.Adams, who is a self employed chiropractor, although he went back to work four days after the accident, claimed he still suffers severe headaches from the injuries.Adams testified when the two vehicles collided his head snapped forward and than backwards and his body twisted sideways. The left front side of his vehicle was damaged. He claims he has recovered from the shoulder and neck injuries but severe headaches still occur daily. He testified of seeing another chiropractor, an orthopedic surgeon, and a neurologist.He claimed his headaches are permanentand that the headaches last for hours.The defense was that it was a low speed accident and that Weyman's car was 2,500 pounds lighter than the doctor's vehicle and it was classified as a minor traffic accident. The defense disputed that the injuries suffered were permanent and claimed the doctor has fully recovered from his injuries.
