Found not guilty

A jury found Ryan John Grutza, 36, of 11 Walnut St., Barnesvillle, not guilty on simple assault and disorderly conduct. Judge Cyrus Palmer Dolbin found him not guilt y as to the summary charge of harassment.Frackville police charged Grutza was one of five men who were engaged in fisticuffs outside a bar in the 200 block on E. Oak St. on Nov. 25, 2010. Grutza was the only one against whom charges were filed. At the time of his arrest his address was Mahanoy City.Revoke probationAlbert P. Chiscavage, 39, Frackville, had his probation revoked by Judge Dolbin and was re-sentenced to serve six to 12 months in the county prison and received credit for serving 83 days. He had pleaded guilty criminal mischief to personal property charged by Frackville Cpl. Marvin Livergood. He was placed on probation in March 2011.His probation violation was because he failed to report on time to his probation officer and was arrested by Pottsville police on an charge of unauthorized used of a vehicle.Guilty pleaJames Garulle, 52, Shenandoah, entered a general plea of guilty to charges of driving under the influence (DUI) of alcohol, failing to obey traffic signal and failing to drive on roadway laned for traffic.Judge Charles M. Miller accepted the guilty plea and deferred sentencing until March 21 to allow the probation department prepare a pre-sentence investigative report for the court. Garulle was cited by Shenandoah Patrolman Michael O'Neil last April 3.Revoke ARDRichard J. Gilmore, Pottsville, was removed from the Accelerated Rehabilative Disposition (ARD) probation program by Judge Dolbin for violating terms of his probation. He now faces trial ona charge of DUI brought by Pottsville Cpl. Mark O'Toole, ast Oct. 8. The ARD program is for first offenders to allow them to serve a probation period of 12 months which will have all charages dropped.Bail hearingsJudge James P. Goodman fixed bail for David W. Smith Jr., 27 Trenton St., Mahanoy City, at $10,000 percentage cash and included several conditions.The conditions include he cannot relocate from his addresss without court approval, must complete anger management classes and undergo drug and alcohol evaluation. Smith faces charges of aggravated assdault, rape, involuntary deviate sexual act, sexual assault, unlawful restraint, simple assault and harassment. He also shall have no contact with the victim.Bail was set for Elizabeth N. Henderson, 20, 929 Scott St., Kulpmont, at $25,000 unsecured. She was charged with retail theft from Walmart Store in Saint Clair.Divorces grantedKendra Deeter, Pottsville, was granted a divorce from Craig Deeter, Hegins. They were married May 11, 2002.Randy L. Wagner, Hegins, was granted a divorce from Jodi A. Wagner, Tremont. They were married Oct. 22, 1999.Linda C. Metz, Mahanoy City, was granted a divorce from Paul J. Metz, Anderson, Calif. They were married May 13, 1989.Tammy L. Moser, Pine Grove, was granted a divorce from Troy L. Moser, Saint Clair. They were married Aug. 27, 2005.
