James Malcolm Thomas, 27, Saint Clair, at his hearing on a motion to dismiss charges filed against him had it granted by Judge John E. Domalakes because the Commonwealth was unable to proceed as the prosecutor, Trooper Timothy J. Rymarkiewicz, failed to appear in court as witness.Thomas was charged with adriving under the influence (DUI) of alcohol last Sept. 3 on Schuylkill Mountain Road in Wayne Township.File for divorceDeann Osenbach, 29 E. Union St., Tamaqua, started a divorce action against Kevin Osenbach, 409 Golf Road, Tamaqua. They were married Nov. 14, 1992.Ryan J. Heffelfinger, 823 Penn Drive, Tamaqua R.D., started a divorce suit against Casey L. Heffelfinger, 145 Cedar St., Lehighton. They were married July 10, 2010.Michele A. Martuscelli, 35 Wayne Avenue, Hometown, started a divorce proceeding against James A. Martuscelli, 654 Monges St., Hazleton. They were married Sept. 16, 1995.LIsa Marton started a divorce suit against Chris Marton, both of 213 N. Lehigh St., Tamaqua. They were marriede May 5, 1993.Divorce grantedChester M. Gangaware was granted a divorce from Patricia Gangaware, both of 16 Spruce Terrace, Nesquehoning. They were married Sept. 10, 2005.Laura Badalamenti was granted a divorce from Rosario Badalamenti, both of Slatington. They were married Sept. 9, 2007.Jayne L. Freedericks, Auburn, was granted a divorce from Dennis A. Fredericks Jr., Pottsville. They were married March 3, 1990.Rebecca A. Reilly was granted a divorce from James Reilly Jr., both of Orwigsburg. They were married April 6, 2002.Erica S. Modyer, Llewellyn, Branch Township, was granted a divorce from Luke W. Moyer, Jersey Shore. They were married April 28, 2008.Warrant hearingsJudge Cyrus Palmer Dolbin held hearings on defendants brought to court on bench warrants which were issued when they failed to keep their court dates and ruled as follows:Bettty J. Ryder, 29, of 223 Valley St., Brockton, Schuylkill Township, had her bench warrant dissolved, the previous bail set was revoked and bail was set at $1,000 cash. She faces charges of driving under the influence (DUI) of alcohol brought by Coaldale Patrolman Charles Blesse.Diane Marie Doncheski, 52, Ringtown, had the bench warrant dissolved, the previous bail set was revoked and bail set at $10,000 percentage cash. She faces charges of DUI of alcohol brought by Pottsville Patrolman Brian W. Kotzmoyer.Joshua M. Canfield, 20, Winter Haven, Fla., had the bench warrant dissolved and the previous bail set reinstated. He faces charges of misbranding of a controlled substance, possession of a controlled substance, possession of a small amount of marijuana and public drunkenness in Pottsville.Bail hearingsJudge Dolbin heard motions from defendants to set bail and handed down the following rulings:Samuel Sanabria, 36, Shenandoah, had his bail revoked and new bail was set at $5,000 straight and since he was unable to post it was committed to the county prison to await trial on charges brought by Shenandoah Patrolman Christopher Zubris.Charges include carrying a firearm without a license, reckless endangering another person and tossing solid objects from an overpass onto a highway. He was also charged by Cpl. Leo Luciani, state trooper, with driving under the influence (DUI) of alcohol on SR924 in West Mahanoy Township.SentencedAngela Marie Tarson, 21, Ashland, who entered a guilty plea last Dec. 12 to a charge of careless driving after a charge of DUI of alcohol was nol prossed was sentenced by Judge Cyrus Palmer Dolbin to pay a fine of $25 plus $50 costs.
