Lansford driver faces drug charges

Published January 11. 2012 05:01PM

Eric Zuber, 30, of 304 W. Bertsch St., Lansford, faces charges from an incident which took place at 3:10 a.m. Oct. 9, 2010, on W. Patterson Street.

Charges of three counts of driving under the influence (DUI), one each of possession of a small amount of marijuana, general lighting requirements, driving on roadways laned for traffic, careless driving, and turning movements and required signals were filed by borough Officer Jason Helmer.

According to an affidavit of probable cause:

Helmer was on duty and in a marked cruiser, traveling east in the 300 block of West Patterson Street (SR209), when he saw a light-colored sedan traveling west, and quickly rounding the bend in the roadway in the area of Kennedy Park. The sedan crossed the double yellow lines into the oncoming lane of traffic. It had a faulty passenger-side headlight.

Helmer turned the cruiser around, and saw the driver turn left onto Cortright Street without using a turn signal.

He stopped the car and identified the driver as Zuber. While speaking with Zuber, Helmer noted the man's mouth was extremely dry, his eyes glassy and he was lethargic and slow to answer questions.

When Zuber got out of the car to take field sobriety tests, Helmer noticed a clear plastic bag in the driver's side door which contained a green, leafy vegetable-like matter. Zuber said it was marijuana for personal use, and that he had smoked the drug about six hours previously.

Zuber failed the field sobriety tests and was taken to St. Luke's Miners Memorial Hospital, Coaldale, for a blood test. The results were positive for marijuana.
