4 area residents among 13 to enter guilty pleas

Four area residents were among 13 defendants who pleaded guilty to criminal charges in Schuylkill County court and were sentenced by President Judge William E. Baldwin as follows:

Timothy J. Postupack, 33, of 31 Vulcan Road, Barnesville, on charges of unlawful restraint of Shannon Ashfield, Saint Clair, and simple assault, was placed on probation 18 months and ordered to pay $100 to Criminal Justice Enhancement Account (CJEA). He was cited by Saint Clair Chief Michael P. Carey.Bryan Anthony McLaughlin, 24, of 134 1/2 Spruce St., Tamaqua, on a charge of possession of drug paraphernalia in Pottsville was placed on probation 12 months, and pay $100 to Substance Abuse Education (SAE) fund. He was cited by Pottsville Patrolman Eugene M. Yourey.Jennifer M. Miller, 30, Tuscarora, Schuylkill Township, on a charge of driving under the influence (DUI) was sentenced to serve 72 hours to six months in the county prison. He reports to the prison on Wednesday, Sept. 28, at 9 a.m. He was also fined $1,000, pay $300 to SAE fund, $50 to Catastrophe fund, make restitution of $60 to Schuylkill Medical Center and enroll in Group Intervention Program. Miller was cited by Tamaqua Patrolman Thomas Duarte. She previously had been placed in the Accelerated Rehabilative Disposition (ARD) probation program for first time offenders but it was revoked for violating conditions.Vincent Robert McDonald, 41, of 208 Market St., Cumbola, Blythe Township, on charges of resisting arrest, simple assault on Robert Miller and criminal mischief, was given credit for spending 28 days in the county prison and released on parole for 18 months, pay a fine of $50 and make restitution of $390.28. He was cited by New Philadelphia Sgt. Eric C. Sterner.Dustin E. Hand, 23, Wiliamstown, on two counts of aggravated assault and one count of DUI was sentenced to serve six to 23 months in the county prison beginning Friday, Sept. 30, at 6 p.m, fined $1,000, enroll in alcohol highway safe driving school, receive outpatient treatment and submit to random screens. On two summary charges, failing to drive on roadway laned for traffic and careless driving fined $50 plus $100 in costs. Hand was city by Trooper Eric Porpiglia on Route 325 in Porter Township.Andrei Marc Ronald Walsh, Orwigsburg, on two counts of possession of a prohibited offensive weapon (sawed-off shotgun) and one count each of terroristic threats and recklessly endangering another person on Fair Road in Wayne Township, was sentenced to serve six to 23 months in the county prison and when released to serve an additional 12 months on probation. Walsh was cited by Trooper Mark Knock.Brian Michael Obrut, 40, Shenandoah, on a charge of driving while his operating privileges were suspended and altering the license plate on his car was sentenced to serve 30 days to six months in the county prison and pay a fine of $1,000. Obrut was cited by Ashland Patrolman Michael O'Neill.Robert Lindenmuth, 24, Mahanoy City, on a charge of delivery of a controlled substance in the borough and possession of drug paraphernalia was sentenced to serve six to 23 months in the county prison with credit for serving 38 days with the sentence to begin Friday, Oct. 21, at 9 a.m and pay $100 to the SAE fund. He was cited by Mahanoy City Cpl. Michael Dissinger.Ashley Williams, 26, Saint Clair, on a charge of disorderly conduct and harassment was fined $600. She was cited by Saint Clair Patrolman Chad H. Seitzinger.Joshua J. McGinley, 34, Locust Gap, on a charge of harassing a person with 18 messages on a cell phone was fined $150. He was cited by Ashland Patrolman Gerard Daley.Benjamin Stephens, 32, Plymouth, on a charge of simple assault on Joel Kislan, Ashland, was placed on probation 23 months, fined $50, pay $50 to CJEA, make restitution of $3,200 to victim and perform 50 hours of community service. Stephens was cited by Ashland Patrolman Michael O'Neill.John Joseph Hulet, 41, Pottsville, on a charge of recklessly endangering another person was sentenced to serve six to 23 months in the county prison beginning Friday, Oct. 21, at 9 a.m. On a criminal mischief charge was fined $100. Hulet was cited by Pottsville Patrolman Charles B. Webber.Alex Lee King, 43, Minersville, on a charge of DUI was sentenced to serve three to six months in the county prison, fined $1,000, pay $50 to CJEA and receive outpatient treatment. King was cited by Minersville Patrolman C. Clink.Richard Eugene Earnst Jr., Shenandoah, on a charge of DUI was sentenced to serve 72 hours to six months in the county prison beginning Sunday, Oct. 9, at 10 a.m., fined $1,000, pay $100 to SAE fund, $50 to CJEA, and make restitution of $60 to Schuylkill Medical Center. On a charge of possession of a drug paraphernalia serve an additional 12 months on probation and on a charge of failing to give notice of name or address change for his driver's license was fined $25 plus $50 costs. Earnst was cited by Trooper Anthony Garipoli on Seven Star Highway in Shenandoah.Each defendant must also pay a $50 per month supervision fee while on probation or parole.
