Bertsch St. when he was caused to slip and fall on "broken, uneven pavement" and due to "debris from construction" taking place at or near the front of the premises.The suit states as a result of the fall Kennedy suffered "severe and permanent bodily injury" which are detailed in the suit.At the time there was a sewer construction project going on in the borough in which defendants Abbonizio Constractors and Cowan and Associates were hired to plan and complete the project for the sewer authority and borough.The four count suit seeks damages in excess of $50,000 on each count alleging negligence against the defendants.The suit was originally filed in the Court of Common Pleas in Philadelphia County but transferred to Carbon by agreement of the parties.
