A case against a Franklin Township kennel owner charged with identity theft has been bound over to court.

That was the ruling made against Patricia E. Gadaleta, 52, of 974 Pohopoco Drive, Lehighton, during a preliminary hearing Wednesday before District Judge Bruce Appleton of Palmerton.Gadaleta, the owner of Musket Labradors, has been charged with one count each of identity theft, theft by unlawful taking, theft by deception, receiving stolen property, and two counts of forgery.Franklin Township Police Chief Thomas Beltz and state Trooper Nicolas De La Iglesia were both called to the stand to testify.A motion by the defense to have the charges of theft by unlawful taking and receiving stolen property against Gadaleta dropped was denied by Appleton.Gadaleta has been recommitted to Carbon County Prison in lieu of $10,000 straight bail. She is scheduled to appear before the Carbon County Court of Common Pleas at 9 a.m. May 12.According to the affidavit of probable cause filed by Beltz:On March 26, 2010, Beltz received a letter from Dennis P. Vasey concerning a complaint filed to his agency in Florida from Patricia A. Gadaleta involving an identity theft incident, according to the affidavit.At about 1:58 p.m. that day, Beltz received a telephone call from Patricia A. Gadaleta from Florida, the affidavit says. Patricia A. Gadaleta from Florida attempted to purchase a new car. At that time, she learned her identity had already been used to purchase a vehicle. Patricia A. Gadaleta did not purchase the vehicle listed to her.During the course of the investigation, Beltz said he learned that in Sept. 2009, Patricia E. Gadaleta, who resides at 974 Pohopoco Drive, in Lehighton, purchased a vehicle, a 2005 Buick bearing vehicle identification number 5GADX33L15D229244 in the name of Patricia A. Gadaleta.On Sept. 22 of that year, a note of security agreement from Wells Fargo Bank was signed by Patricia Gadaleta. The borrower was identified as Patricia A. Gadaleta, 974 Pohopoco Drive, Lehighton, Pa. 18235. Patricia A. Gadaleta resides in Florida, and she was not the person receiving the note of security agreement. Patricia E. Gadaleta, 974 Pohopoco Drive, Lehighton, was the person receiving the note and she was the person benefiting from the note and sale of the vehicle.On Sept. , Patricia E. Gadaleta applied for an application for a duplicate title with the state Department of Transportation. Under the owner section the owner name was listed as shown on the original title as Patricia A. Gadaleta. Written over the middle initial of A. was the letter E., in an attempt to change the name from Patricia A. Gadaleta to the name of Patricia E. Gadaleta.During the course of investigation, Patricia A. Gadaleta learned Patricia E. Gadaleta has been using her social security number to procure loans from pay day. Those loans have not been authorized by Patricia A. Gadaleta, nor did Patricia A. Gadaleta ever give permission to Patricia E. Gadaleta to use, sign or in any way permit her authorization to use her identity.
