Mark Yacovelli, 41, Mahanoy City, was resentenced by Judge John E. Domalakes to serve 60 to 120 days in the county prison on a charge of driving while his operating privileges were suspended-DUI related.He was first sentenced on July 28, 2009, to serve a flat 60 days prison sentence after Judge Domalakes adjudged him guilty of a summary charge of driving while his license was suspended-DUI related. Yacovelli appealed the sentence to the Pennsylvania Superior Court, which by a two to one vote, vacated the sentence because it was a "flat sentence which violated the minimum-maximum rule of the Pennsylvania Sentencing Code."The higher court ruled, "The Pennsylvania's Sentencing Code requires that for every sentence of total confinement, the trail court must impose both a minimum and maxmum sentence." The court stated, "We are constrained to vacate the illegal sentence and to remand for resentencing consistent with the memorandum."A dissenting opinion was filed by Judge Cleland who stated, "I respectfully disagree with Judges Gantman and Popovich. Their interpretation does not account for the significant additional administrative burdens that its interpretation will create by providing parole supervision for summary offenses. If the state legislature intended to require that in summary cases a defendant petition for parole and the county probation department then assume supervision, the legislature would have clearly expressed its intention to impose these additional burdens on defendants, prosecutors, courts and probation department."Credit card suitsLVNV Funding, LLC, Greeenville, N.C., filed a petition to court claiming Gwynn Lazorich, 652 Catawissa Road, Tamaqua R.D., owed a balance of $2,400.80 on a credit card.Portfolio Recovery, LLC, Norfolk, Va., filed suit against Pamela J. Schramm-Marks, 34, Schuylkill Haven, was found not guilty by a jury of a charge of simple assault and Judge Cyrus Palmer Dolbin found her not guilty of the remaining charges filed by Schuylkill Haven Patrolman David T. George, of harassment and disorderly conduct.After a nonjury trial Dana Anne Seisler, 36, Auburn, was found not guity by Judge John E. Domalakes of charges of driving under the influence of alcohol (DUI), driving an unregistered vehicle and failing to drive on right side of road last July 4 in Pine Grove. The charges were filed by Pine Grove Sgt. Jeffrey Futchko.Accident suitUnitrin Direct Property and Casualty Company, Dallas, Tex., filed a civil suit against Dean A. Finnefrock, 315 E. Broad St., Tamaqua, and Brian Tyan, 322 North St., Elkton, Md., concerning an motor vehicle accident. The complaint states on March 19, 2009, Finnefrock was operating a vehicle owned by Tyan traveling west on SR209 in Pottsville and allegedly ran a red traffic light and struck the plaintiff's insured vehicle. In the suit it is alleged there was no insurance on the vehicle an the vehicle was a total loss. The suit seeks damages in excess of $50,000.Seek foreclosureU.S. Bank National Association, trustee for Pennsylvania Finance Agency, Harrisburg, filed a civil action against Sarah C. Anderson, also known as Sarah C. Panzer, 114 Retreat Road, New Ringgold, alleging defaulted on mortgage payments on property at 144 Sixth St., Coaldale, and seeks to foreclose on the property.
