A Kelayres man has been charged with stealing almost $5,000 from an elderly man who resided at the White Owl Manor Nursing Home in Mahanoy St.

James F. McGill Jr., 58, who owns the nursing home, allegedly used a stolen ATM card to remove $4,926 from the bank account of William J. Barlow Jr., 80, between Aug. 16 and Aug. 30, 2010. McGill withdrew the money at the Sovereign Bank Branch in Hometown.According to testimony provided by the victim, he never owned an ATM card, a fact he relayed to McGill. He also stated McGill then presented him with the paperwork to obtain such a card, but Barlow never received one.A preliminary hearing for McGill was held Tuesday in the office of District Judge Steven Bayer, Tamaqua. McGill pleaded not guilty, but the judge found enough evidence to bind him over for criminal court trial on charges of access device fraud, identity theft and theft by unlawful taking. The charges were filed by Pennsylvania State Trooper Edward Lizewski.Lizewski provided evidence of 13 withdrawals from McGill's account during the time frame in question. A review of video footage taken from the ATM machine at the Hometown bank showed McGill making transactions coinciding with the dates and times of those withdrawals.McGill was released on $25,000 percentage bail, with the stipulation that he stay away from the nursing home.
