Hearing on indecent exposure charge continued for man, 75

A hearing for a Palmerton man charged with indecent exposure has again been continued.

Benedict Flynn, 75, was scheduled to have a preliminary hearing before District Magistrate Bruce Appleton of Palmerton on Wednesday.But, Flynn is currently in a nursing home, and was unable to attend the hearing. No new hearing date has yet to be scheduled.According to an affidavit of probable cause filed by borough patrolman Trevor Flexer:On Feb. 22, 2010, Flexer was met at the borough police department by a female along with her daughter to report a crime, according to the affidavit.Flexer asked the woman what crime had happened, at which point she stated that her daughter saw a naked man, the affidavit says. The woman informed Flexer the incident occurred back in Oct. of 2009.Flexer asked the woman and her daughter if either of them knew the male's name. They pulled out a piece of paper and stated "Benedict Flynn".Flexer then asked the woman for the details of the incident, at which time she stated that on Oct. 23, 2009, at about 5 p.m., she, her daughter, along with a few other friends were walking up Hillside Avenue to a friend, whose house was located on West Princeton Avenue.The woman stated that as they walked up Hillside Avenue, they saw a male standing at the doorway. The woman stated that they arrived at the friend's residence and walked back down Hillside Avenue to go to her adopted sister's house, and stated that they waited near the door to Flynn's apartment.The woman stated that while they were waiting, Flynn opened the door, and he was totally naked. The woman stated that once she saw Flynn standing there naked, the four of them ran away.On Feb. 23, 2010, Flexer said he interviewed one of the woman's friends regarding the incident, at which time the individual gave the same details.On Feb. 24, 2010, borough police Chief Randy Smith interviewed another of the woman's friends regarding the incident. That individual also gave the same details of the incident.The other juveniles were interviewed but had not seen anything.
