Box 866, Moscow, Pa., has filed judgments it received in rulings from District Justice Joseph Homanko against property owners who have failed to pay annual service fees and special lake front assessments for their properties.The defendants are Margot Krum of Mechanicsburg, for a property at 714 Timberline Drive in the development; judgment in the amount of $2,964.48; and Charles and Nancy Gregory of Holland, Pa., for a property at 507 Estates Drive; judgment in amount of $1,006.99.Subrogee suesThe Merchants Insurance Group, Buffalo, N.Y., as subrogee of Aubrey and Desiree Warner, 111 Patten Circle, Albrightsville, has filed a civil action against Sunrise Homes, a/k/a Sunrise Homes, Inc., Dairy Lane, Brodheadsville, and J & N Bond Plumbing, Inc., Saylorsburg.The suit claims Merchants insured the couple for a home built by Sunrise, which subcontracted J & N to install a Jacuzzi tub in the upstairs bathroom of the residence, and that on or about Jan. 2, 2009, an anti-scald mixing valve on the Jacuzzi malfunctioned and caused large amount of water to escape the plumbing and enter the Warners' home.The insurance company said as a result of the malfunction damages suffered by the Warners included water damage to the floors, ceilings, walls, trim, doors and various items of their personal property amounting to $4,801.83.A five-count complaint alleges issues of strict liability, negligence, breach of warranty, breach of implied warranty and merchantability and breach of implied warranty of fitness for a particular purpose against the defendants.
