A Carbon County woman was sentenced to a short county prison term Monday for driving under the influence (DUI) but faces a big restitution bill for injuries she caused to another person in an accident involved in the case. She was one of several defendants, who previously pleaded guilty, to be sentenced by Carbon Senior Judge Richard W. Webb.

Kidder incidentBrandy L. Yagalla, 24, of Weatherly, was sentenced to serve 48 hours to six months in prison for an incident that occurred on Nov. 29, 2009, along SR534 in Kidder Township. She was involved in an accident which the victim, Michelle Schaffer, sustained serious injuries. Given a blood test, the result was .11BAC.Webb ordered Yagalla to pay medical bills totaling $16,922.95. Some of the bills were covered by Yagalla's insurance and according to defense Atty. Bruce Miller, another insurance claim could yield $9,000 in payments to the victim.Schaeffer told Webb the incident had severely affected her life. She said she is unable to work, continues to receive medical treatment, sees three doctors for her condition and is in constant pain.Webb said, "This is what happens in DUI related accidents, innocent people suffer."Webb said any amount of the restitution that is not covered by insurance must be paid by Yagalla. She was also ordered to get a drug and alcohol (D&A) evaluation and follow any recommendation for treatment.Drugs in jailJoseph Lewis Moyer Sr., 57, of Lansford, was sentenced to a county prison term on a charge of possession of a controlled substance-heroin. He was arrested by Nesquehoning police for an incident on Feb. 12 at the county prison.Police said Moyer, who was in jail on a motor vehicle code violation, brought 10 bags of heroin into the prison.Webb sentenced him to serve one day less 12 months to one day less 24 months in jail on the possession charge.On a charge of accidents involving personal injury for an incident on Nov. 17, 2009, in Franklin Township, he was sentenced to serve nine to 18 months in prison to run concurrent with the drug charge. He was involved in a accident causing injuries to another person.Webb gave him credit for 326 days spent in jail to date on the charges. He was also ordered to get a D&A evaluation, made eligible for the re-entry program and zero tolerance imposed on D&A use.DUI casesTwo defendants were sentenced to jail terms on DUI charges.Jarred Ricky Lee West, 19, of Lehighton, was sentenced to serve 72 hours to six months in prison. He was arrested on June 23, 2009, at Springgarden and Abbott streets., in Lansford. Given a test, the result showed the presence of a controlled substance in his system.He was also ordered to get a D&A evaluation, pay restitution of $352, pay a fine of $1,000, license suspended for a year, and zero tolerance on D&A use.On a charge of recklessly endangering another person he was placed on probation for a year, to run consecutive to the DUI term. On a summary motor vehicle code violation he was fined $25 and costs.He began the jail term on Tuesday, Nov. 30, at 9 a.m.Guy Francis Hartman, 47, of Ashfield, was sentenced to serve 45 days to six months in prison. He was arrested on Oct. 3, 2009, by state police along Bridge St., in Franklin Township. Given a test, the result was .15BAC.He was also ordered to get a D&A evaluation, pay a fine of $750, and one year license suspension. On a summary offense he was fined $25 and costs.He will serve the jail term on consecutive weekends beginning Friday, Dec. 3, at 6 p.m.Each defendant must also pay court costs and a $50 per month supervision fee while on probation or parole.
