Palmerton resident granted application to build deck

A permit application has been granted to a Palmerton man to build a deck onto his property.

The borough's zoning hearing board on Monday unanimously agreed to grant Joseph Uhnak the application to erect a deck to his dwelling unit at 884 E. Princeton Avenue.Uhnak, who was accompanied by his wife, said the deck would be 15-feet-by-30-feet, and zero feet from the side property line."The topography of the property creates a hardship for us," Uhnak said. "To build on the back of the house, the deck would be at the second floor level."Further, Uhnak told zoners his neighbor, Steve Duyka, has given his consent for Uhnak to build the deck."The deck would not directly interfere with his home," Uhnak said. "We want an affordable and accessible usable deck."Duyka, who was in attendance, told zoners he was aware of the deck, and added that Uhnak "talked to me about it."After it heard from Uhnak, the zoners were quick to make their decision to grant him a permit application.In his rejection letter dated Oct. 20, borough zoning officer Duane Dellecker noted that Uhnak's property is located in an R-1, low density residential, zoning district.However, Dellecker said a section of the borough zoning ordinance requires a minimum setback of three feet from the side property line.
