Carbon man pleads guilty in seven criminal cases

A Carbon County man entered guilty pleas on Tuesday in Carbon County court in seven pending crminal cases. He was one of 10 defendants to enter a plea before Senior Judge Richard W. Webb.

Theft incidentsBradley S. Allen, 34, of Bowmanstown, pleaded guilty to four counts of retail theft and one count each to theft, receiving stolen property and resisting arrest.Allen was charged with retail theft incidents at the Convenient Store, Spillane's Variety Store, Pereira's Service Station, all in Palmerton, and the CVS Pharmacy in Nesquehoning. He also admitted stealing various presciption pills from Christopher Neff. The theft incidents occurred in late 2009 and early 2010.The resisting arrest offense occurred on Aug. 13 in Palmerton when police attempted to serve an arrest warrant on him on the theft counts. He has been in the county prison since his arrest.Allen admitted to a long-term drug addiction problem and stole, he said, to feed his habit.Webb accepted the pleads but deferred sentencing and ordered the adult probation office to prepare a presentence investigation (PSI) report that will include a drug and alcohol (D&A) evaluation.Other pleasOther defendants who entered gulty pleas included:Arlington A. Solt III, 42, of Kunkletown, pleaded guilty to one count of possession with intent to deliver a controlled substance-marijuana. He was arrested on Sept. 17, 2009, at his residence in Lower Towamensing Township.The police report indicated they learned from another source that Solt was selling marijuana. When police went to his home they found Solt was growing marijuana plants at his residence.Webb deferred sentencing and ordered a PSI.Keith Silverthorn, 38, of Palmerton, pleaded to one count of driving under the influence (DUI). He was arrested on July 24, along SR248 in Palmerton. Given a test, the result was .16BAC. He also has a pending DUI charge in Northampton County.As a first offense, Webb placed him on probation for six months and ordered he pay a fine of $300 and get a D&A evaluation. On a summary motor vehicle code offense he was fined $25 and costs.Danny T. Seiler, 39, of Kunkletown, pleaded to one count of DUI. He was arrested on Feb. 1, 2009, along Fireline Rd., in Towamensing Township, after being involved in an accident. Given a test, the result was .19BAC.Webb sentenced him to serve 10 days to six months in jail, a fine of $300, license suspended for a year and to get a D&A evaluation. He begins the jail term on Nov. 12 at 7 p.m. and will serve it on consecutive weekends.Chuck Stinson, 45, of Lansford, pleaded to one count of DUI. He was arrested on Dec. 3, 2009, along SR209 in Franklin Township. Given a test, the result showed a .04BAC and the presence of a controlled substance.Webb deferred sentencing so Stinson could apply for placement in the Intermediate Punishment Program (IPP).Kenneth Charles Brothers, 54, of Lehighton, pleaded to one count of DUI. He was arrested on April 7 along S. Second St., in Lehighton. Given a test, the result was .21BAC.Webb deferred sentencing so Brothers could apply for the IPP.Matthew Gerald Desrochers, 38, of Lehighton, pleaded to one count of receiving stolen property. He was arrested on Dec. 17, 2009, for an incident in Franklin Township. He was charged with taking jewelry and other items from Stephen Franco. Desrochers is currently in the Northampton County prison facing additional criminal charges.Webb deferred sentencing and ordered a PSI.Angel Luis Filomeno III, 19, of Jim Thorpe, pleaded to one count each of resisting arrest and false identification to law enforcement. He was arrested on Aug. 12 by Jim Thorpe police who had a warrant for his arrest from another county. He resisted arrest and then when taken into custody gave a false name. He has pending charges in Lehigh and Montogmery counties and is in custody on those counts.Webb sentenced him to time served (six days) to one year in jail, on both counts running concurrently. He was paroled but remains in custody. His next court appearance will be in Lehigh County.Joseph Pizzutti, 64, of Nesquehoning, pleaded to one count of receiving stolen property. He was arrested by Nesquehoning police for an incident on July 12, 2009.Pizzutti found a wallet belonging to Robert Padora near the Turkey Hill store. He claimed that the wallet had no identification in it and he thought "it came from God." He spent $280 of the cash in the wallet on lottery tickets. Webb said he should have known to turn it over to police.Webb noted that Pizzutti has a prior mental health history. He placed him on probation for a year and ordered he make restitution to the victim of $520.Tara Searfoss, 24, of Lehighton, pleaded to one count of access device fraud. She admitted taking a credit/debit card of her father, Danny Searfoss, and making unauthorized withdrawals from a ATM machine. She claimed she took the money to buy heroin to feed her habit. She also claimed she has been drug free for the past five months.Prior to the plea Searfoss appeared on a bench warrant for failing to show for a prior guilty plea proceeding on Oct. 21.Webb sentenced her to time served (nine days) to one year in jail, and ordered she get a D&A evaluation, zero tolerance imposed on D&A use and she must make restitution to her father for $161.50.Each defendant sentenced must pay court costs and a $50 per month supervision fee while on probation or parole.
