A number of rulings and sentencings were made by Schuylkill County judges in criminal matters on motions made on behalf of defendants recently.

Joseph Cierlitsky, 19, of 1078 West Penn Pike, Tamaqua, was granted a motion to modify his bail. He had been charged with theft from a motor vehicle.The modification imposed by Judge John E. Domalakes was that his address is modified to allow him to reside at Altoona Detox Center, Altoona, for admission purposes, in event a move from this address should incur the district attorney and his Adult Probation Officer should be informed immediately. Upon completion of his rehabilitation program he is permitted to reside at 47 Mushdahl Road, New Ringgold.Mario Mascolo, 55, of 23 W. Ruddle St., Coaldale, had his bail reduced from $20,000 percentage to $500 percentage by Domalakles. Other stipulations include, he shall reside at the current Coaldale address, shall not consume or possess alcohol or have any present at his residence, shall continue with AA meetings, continue to take his prescribed medications, submit to random urinalysis and must not drive a motor vehicle while his license is suspended.Levi Warren, 27, Tamaqua, after being brought to court on a bench warrant and after receiving a hearing before Domalakes had the bench warrant dissolved and his bail reinstated and remains at $10,000 unsecured (he does not have to post any money but if he fails to appear in court he is liable for the full amount). He also was ordered by the court to reside at 13 Mauch Chunk St., Tamaqua, and if he moves to notify the DA and his probation officer immediately. He faces assault charges brought by Patrolman Michael Hobbs, Tamaqua police.Michael Berdecia Jr., 23, Shenandoah, after a hearing before Domalakes had his motion to reduce bail granted and reduced from $25,000 straight cash bail to $1 and he must reside at 25 N. West St., Shenandoah and if he moves to notify the DA and his probation officer and must have no contact with witnesses or victim. Berdecia was charged by Patrolman Robert Senape, Shenandoah police, with criminal conspiracy, aggravated and simple assault and recklessly endangering another person.Keith D. Neff, 27, of 356 W. Abbott St., Lansford, admitted to violating his parole and was recommitted by Domalakes to the county prison with a loss of 43 days at liberty which were added to his current maximum date of release which is extended to Sept. 14, 2011. The court gave him an opportunity to be re-paroled if he is accepted into an inpatient rehabilitation program. Neff was charged Rush Township Patrolman Duane Frederick in June 2007 with theft of a purse from a handicapped person in the Walmart store and had pleaded guilty and was twice re-paroled from his probation sentence.Robert Ryan, 32, Barnesville, had his motion to modify his bail was denied by Judge D. Michael Stine who ordered bail remain at $25,000 percentage and must abide by terms fixed by the court, which were: the defendant shall reside at 21 E. Lakewood Avenue, Barnesville, shall have a drug and alcohol evaluation, shall not travel outside the Commonwealth without court approval and if he travels he must maintain contact with his probation officer one time weekly by telephone and pay the associated cost and he shall have no contact with the victim in the case. He faces assault charges.Frank Ciekalsky, 41, of 59 N. Sheridan St., McAdoo, on his petition to modify bail was granted by Senior Judge S.J. Brenner and the bail was set at $1,000 unsecured bail. He faces alleged simple assault charge.Richard Ludwig, 37, Ringtown, was denied by Brenner to have his bail modified and it remains at $25,000 percentage and further ordered to remain in contact with his probation officer one time weekly by telephone and pay for its cost and have no contact with the victim in this case. He faces charges of aggravated assault.Edward Hardison, 30, Ashland, had his bail modified by Brenner to $25,000 percentage and he further must keep in contact with his probation officer one time weekly and shall not consume any alcoholic beverages.Angela Sememtelli, 29, Pottsville, after a hearing before Domalakes the bench warrant issued against her was dissolved and bail was reinstated at $5,000 unsecured. She also has to reside at 809 Vine Street, Pottsville, and notify the DA and her probation officer if she changes addresses. She was cited by the state attorney general's office with violation of the public welfare code.Troy D. Langtry, 47, Pottsville, after a hearing before Domalakes had the bench warrant issued to bring him to court dissolved and bail was set at $100,000 straight and he was remanded to the county prison because he could not post the bail. Langtry was charged by Patrolman Brian Pyle, Branch/Reily Townships police, with three counts of simple assault, two counts of recklessly endangering another person and one count each of possession of drug paraphernalia, fleeing police and carrying a firearm when not permitted.Teresa A. Caruso, 49, Pottsville, was removed by Stine from the Intermediate Punishment Program (IPP) after a hearing. She was found by court to have violated her probation by dealing in drugs. She was resentenced on two counts of driving under the influence (DUI) of alcohol to serve one to five years in the county prison with credit for serving 224 days. She had been placed in the IPP last January to serve 60 months on probation under certain specific terms including house arrest.Kevin Ray Kline, 43, Reading, who entered a guilty pleas to a charge of retail theft, was sentenced by Judge Cyrus Palmer Dolbin to serve five months on parole after receiving credit for serving 22 days in the county prison. The sentence is to run concurrent with a sentence now serving in Berks County and he will be supervised by Berks County Probation Department. He pleaded guilty to theft of two bottles of liquor from the state liquor store in Schuylkill Haven and must make restitution of $125 to the store.
