Schuylkill Co. judge orders controller to finish reports

A few hours after he held a hearing Friday in the judge's chambers at the Schuylkill County Court House on the mandamus action brought by the Schuylkill County Commissioners against Controller Melinda Kantner, Judge Charles M. Miller issued a speedy ruling.

The action concerned the delay of issuing the audit on the financial expenditures of the county in 2009. The judge directed Kantner to perform on or before October 1 the following:• Complete and file her annual report to the Court of Common Pleas of Schuylkill County in complete accordance with the county code.• Make her annual report to the Pennsylvania Department of Community and Economic Development of the financial condition of the county in complete accordance with the county code.• Publish the requisite notices required by and in accordance with the county code.Failure to comply with the court order shall subject Kantner to contempt proceedings.The mandamus action was filed in the Schuylkill County Court on August 23, claiming Kantner "has refused and continues to refuse" to complete a state-mandated county financial reports which were due July 1. Kantner's response was that Samuel Deegan of Pottsville, the auditor hired by the county, was to blame for the delay .Judge Miller met Friday morning in his chambers with attorneys for the commissioners and controller for a conference on the suit and both sides gave their views.
