Eight area residents among 40 placed in probation program

Eight area residents were among 40 first time offenders who were recommended by Schuylkill County District Attorney James P. Goodman for the Accelerated Rehabilitation Disposition (ARD) special probation program for first time offenders. President Judge William E. Baldwin admitted them into the program and imposed conditons they must complete. A person does not admit guilt in entering the program.

All were placed for a year unless otherwise noted.Candace Louise Bylinski, 26, of 505 Rolling Mill Ave., Tamaqua, charged by Patrolman Richard Pugh, Pottsville police on June 21, 2009, with driving under the influence (DUI) of alcohol and drugs wa assessed $500 to defray the cost of the program, pay $300 to Substance Abuse Education (SAE) fund, $50 to Criminal Justice Enhancement Account (CJEA), $60 to Schuylkill Medical Center (SMC) for lab work, attend alcohol highway safety school, receive outpatient counseling, perform 10 hours community service and driver's license is suspended 60 days. On a summary charge of careless driving was fined $25 plus $50 costs.Nicholas D'Angelo, 19, of 334 Pine St., Tamaqua, charged by Patrolman Matthew Bynon, Tamaqua police, with theft and defiant trespass at Hegarty Towers Building, 101 Pine St., last Nov. 19, was assessed $350 for the program, and pay $50 to CJEA.David Thomas Lehman, 21, of 26 W. Ludlow St., Summit Hill, charged by Patrolman Brian Thompson, Rush Township police, with being involved in an accident with an attended vehicle last Dec. 18, was assessed $350, pay $50 to CJEA and perform 10 hours of community service. On a summary charge of following too closely was fined $25 and $50 costs. The police report stated he was involved in a collision on Tide Road with a car drivien by Joseph Carroll III.Michael Steven Laganowski, 38, of 97 Main St., Freeland, charged by Patrolman Christopher Hand, Frackville police, with DUI of alcohol and drugs last Jan. 17, was assessed $500 for the program, pay $300 to SAE fund, $50 to CJEA, $60 to SCM, perform 10 hours community service, attend safety school, undergo intensive outpatient substance abuse counseling and license suspended 60 days. On a summary charge of driving while license suspended was fined $200 and exceeding maximum speed limit by traveling 75 miles-per-hour in 35 zone fined $25 plus $100 in costs.Lyle Keith Mantz III, 26, of 203 W. Holland St., Summit Hill, charged by Patrolman Thomas Duarte, Tamaqua police, with DUI last Dec. 29 was assessed $500, pay $100 to SAE fund, $50 to CJEA, and perform 10 hours community service.James McDonald Jr.,31, of 434 E. Tucci, 34, Pottsville, charged by Patrolman Shawn Tray, West Mahanoy Township police, with cashing a bad check was assessed $350, $50 to CJEA, $50 to district attorney's office for bench warrant, perform, 10 hours community service, and make restitution of $249.90 to victim.Thomas Valle, 51, Pottsville, charged by State Attorney General's Office with violation of the public welfare code, was assessed $350, $50 to CJEA, perform 30 hours of community service, and make restitution of $3,577. Vale asked the court if his probation ends when he pays off the restitution. "No," answered Baldwin, "you have to serve the two years."Veronique Sophie Vlaun, 36, Reading, charged by Patrolman Richard J. Pugh, Pottsville police, with selling or furnishing alcohol beverages to minors, was assessed $350, $50 to CJEA, and perform 10 hours community service.Each defendant must also pay court costs and a $50 per month supervision fee while in the program.
