Tamaqua man given third chance for probation

Normally a judge will remand a defendant to prison on a second parole violation. But Phillip G. Brinich, 30, of 24 E. Elm St., Tamaqua, is getting a third chance and he can thank his mother for keeping him out of jail.

After a hearing held Monday in Schuylkill County Court Judge Charles M. Miller granted the request to have him admitted as an inpatient for treatment at White Deer Run and Blue Mountain facility located in Kempton. His mother's persistant attempt acquired him a bed in this facility.Brinich was sentenced to serve an additional 36 months on probation and was warned by Miller that failure to complete his stay at the facility would constitute a violation of his probation and he would spend the remainder of his sentence behind bars. The judge told him this was his last opportunity and it was about time he started a new life so he can care for his two small children, ages two and 10.Briinich took the witness stand and admitted his parole violation as claimed by his probation officer but said he had a drug addiction and needed help. His mother, Pat, testified incarceration will not serve the purpose to get him back to normalcy and blamed the addiction for causing the parole violations. She also told of her effort in obtaining a bed for her son because as she claimed he needed help.Brinich orginally had pleaded guilty to charges of forging a doctor's prescription to obtain drugs. On May 21, 2009, he was sentenced to serve 23 months on probation and was admitted as an inpatient at Pyramid rehab center in Altoona but five days later he left the establishment which was a parole violation. He was re-sentenced in September 2009 to continue on probation but was found to again violating the terms, failure to report regularly to his parole officer and was found to possess illegal drugs.
