Lansford man pleads to DUI

"I guess I will have to walk to my job to Hazleton, Patrick J. Kelly Jr, 24, of 139 W. Ridge St., Lansford, told Judge Jackqueline Russell after he learned his driver's license will be suspended one year following his guilty plea to a charge of driving under the influence (DUI).

Kelly was sentenced Monday afternoon in Schuylkill County courthouse to spend 24 hours in the county prison beginning at noon Saturday, June 26, and to be released at noon the next day. His sentence was to spend a minimum 48 hours in prison, however, he already had spent one day in prison and when released to serve six months on probation.Kelly was told when he enters the prison he must surrender his driver's license. He said he had no one to provide transportation. The judge said the suspension was mandatory under the law. That was when he made the comment about walking.He also said if his wife goes into labor how is he to get her to the hospital. The judge had no response. Kelly also must pay a fine of $500 and costs of prosecution, pay $100 to Substance Abuse Education (SAE) fund, $50 to Criminal Justice Enhancement Accout (CJEA) and a $50 per month supervsion fee. He was cited by Patrolman Charles Blesse, Coaldale police, last August along SR209.Revoke probationSherri Wagner, of 428 Arlington St., Tamaqua, had her probation revoked by Judge Russell Monday afternoon because she used crack cocaine in violation of her probation. She was resentenced to serve three to 12 months in the county prison and received credit for already serving 32 days. She also must pay $50 to CJEA, a $50 a month supervision fee fee and court costs.She was originally sentenced on Aug. 28, 2008, after pleading guilty to forgery charges and was placed on probation. Wagner told Russell she needed help to overcome a drug habit. The judge told her if she is able to find a place to go for treatment she would consider releasing her on probation. Wagner was cited by Patrolman Stanley Stanell, Tamaqua police. She had used a credit card belonging to someone else which was left at a service station.Alexis Goldberg, 19, of 37 E. Ridge St., Lansford, was released on bail by Judge Charles M. Miller Friday after a hearing in court. He was also placed under a number of restrictions including he can't change his address or travel out of state without written permission from the district attorney's office, shall not possess nor consume alcoholic beverages, controlled substance or have drug paraphernalia, shall submit to random urinalysis or other drug testing, shall secure and maintain gainful employment and have no contact with the victim. Golberg faces charges of burglary criminal trespass and theft.
