Guilty pleas entered in Schuylkill
A Schuylkill Haven man pleaded guilty to theft at Heisler's Dairy and a Cumbola woman to retail theft at a chain store. Both were among 29 others who entered guilty pleas recently before Judge D. Michael Stine in Schuylkill County court and were sentenced as follows:
Richard David Cannauccuolo, 19, for the theft at Heisler's was sentenced to serve 23 months on probation, make restitution of $646.60 to the dairy, pay $100 to Substance Abuse Education (SAE)) fund, $50 to Criminal Justice Enhancement Account (CJEA), and a fine of $100. He also was fined $100 on a retail theft charge and on another theft charge of two cans of beer from Keg's Kasen Inc., SR61, North Manheim Township, received a concurrent 12 months probation sentence but has to pay an additilonal $100 to SAE fund, $50 to CJEA and a $150 fine. He received credit for spending 51 days in the county prison.Renee Marie Austerberry, 24, Cumbola, Blythe Township, retail theft, placed in the Intermediate Punishment Program (IPP) for 23 months with the first 30 days spent in the county prison. However, she had already served the 30 days and was released and placed on under house arrest for 60 days with electronic monitoring and pay a $12 per day fee, followed by 20 months of probation; pay a fine of $100, and pay $50 to SAE fund. Austerberry was charged with theft of 109 items from Walmart Store in Saint Clair.Francis Theodore Green, 26, of 334 W. Centre St., Mahanoy City, on a driving under the influence (DUI) charge was sentenced to serve 72 hours to six months in the county prison last Friday and Saturday and granted immedate parole upon completion of his minimum sentence. He was placed on parole for six months, pay a fine of $1,000, pay $300 to SAE fund, $50 to catastrophe fund, undergo intensive outpatient counseling, make restitution of $60 to Schuylkill Medical Center and driver's license is suspended 12 months. On a summary charge of failing to obey a traffic signal was fined $25 plus $50 costs.Jamie Lee Majors, 44, of 525 W. Pine St., Mahanoy City, disorderly conduct in Shenandoah tavern, pay a $150 and pay $50 to CJEA fund.Thomas J. Turo, 45, of 507 W. Pine St., Mahanoy City, DUI, placed on probation six months, pay a fine of $300, pay $100 to SAE fund, $100 to Catastrophe fund, and perform 10 hours community service. On two counts of harassment of police officers received concurrent 12 months probation on each charge. On a charge of careless driving was fined $25 plus $50 costs.Michael M. Cecchini, 46, Shenandoah, disorderly conduct, six months probation, $150 fine, $50 to CJEA, and 20 hours community service. Information filed claimes he got into an argument with a neighbor who was shoveling snow for throwing snow on his property.Alex J. Fogerty, 20, Lost Creek, West Mahanoy Township, was sentenced on a number of criminal charges: DUI, serve 72 hours to six months in the county prison, pay $1,000 fine, $100 to SAE fund, $50 to Catastrophe fund, receive outpatient substance abuse counseling, pay $60 to Schuykill Medical Center and license suspended 12 months. He had previously been in the Accelerated Rehabilative Disposition (ARD) probation program which was revoked. On a charge of delivery of a controlled substance in Shenandoah was given credit for 28 days served and given an additional 12 months probation, pay $100 to SAE fund, $50 to CJEA. On a charge of possession of drug paraphernalia to serve an additional 11 months probation.On a charge of fleeing West Mahanoy Township police was placed on probation 23 months to run concurrent with the other sentences, pay a fine of $150, pay $50 to CJEA, and perform 20 hours of community service. On a charge of possession of drug paraphernalia at his home received no additional time but was fined $100, pay $100 to SAE fund, $50 to CJEA and perform 20 hours community service. His total seventence was 72 hours in jail and 29 months probation.Robert Joseph Jones, 36, Pottsville, DUI, placed in IPP for five years with 30 days spent in the county prison followed by four years and 11 months various probation restrictions, pay a fine of $1,500, pay $100 to SAE fund, $200 to Catastrophe fund, complete outpatient counseling and license suspended 18 months. On a summary charge of failing to drive on right side of road fined $25 and $50 costs and for not wearing a seat belt fined $10 and $50 costs.Stephanie M. Knorr, 22, Frackville, on a charge of assaulting Samamtha Krawczyk and Shantae Kline, Shenandoah, was placed on probation 23 months, pay a fine of $100 and $50 to CJEA.Laurie A. Lambert, 50, Pine Grove, DUI, serve 72 hours to six months in county prison, fined $1,000, pay $300 to SAE fund, $100 to Catastrophe fund, $60 to Schuylkill Medical Center, and receive outpatient counseling. On a charge of failing to drive on right side of road fined $25 plus $50 costs. On a charge of terroristic threats was ordered to serve an additional 12 months on probation, pay a $100 fine, $50 to CJEA and on a charge of disorderly conduct fined $100 and costs.Michael John Liptok Jr., 23, Pottsville, stalking and simple assault on Rose Mary Zweizig, placed on probation 12 months, pay a fine of $100, and pay $50 to CJEA.Adam Joseph Powell, 24, Ashland, access device fraud, placed on probation 23 months, pay a fine of $150, and pay $50 to CJEA. He received credit for seven days spent in prison.Frank C. Rakus, Ringtown, DUI, 72 hours to six months in county prison, $1,000 fine, pay $300 to SAE fund, $50 to Catastrophe fund and license suspended 12 months. On a charge of failing to drive on roadway laned for traffic fined $25, careless driving, fined $25 and failure to wear safety belt fined $10 plus $150 in costs.Jeffrey James Reybitz, 40, Bethlehem, DUI, served 48 hours in the county prison and released on parole for six months, pay a fine of $500, pay $100 to SAE fund, $50 to catastrophe fund, receive outpatient counseling and his license is suspended 12 months.Nathan P. Salvodore, Ringtown, DUI, placed on probation six months, pay a fine of $300, pay $100 to SAE fund, $50 to Catastrophe fund, receive outpatient counseling, and make restitution of $60 to Schuylkill Medical Center. On a charge of failing to drive at a safe speed was fined $25 plus $50 costs.Michael Jarod Schultz, 20, Frackville, disorderly conduct, placed on probation 12 months, pay a fine of $150, and pay $50 to CJEA. On a charge of criminal mischief to a truck was fined $75 and costs.Andre Donald Soto, 30, Saint Clair, DUI, serve 72 hours in the county prison beginning June 11 at 10 a.m. and when minimum sentence is completed placed on parole for six months, pay $100 to SAE fund,. $50 to Catastrophe fund, a fine of $1,000, receive outpatient substance abuse counseling and license suspended 12 months. On a charge of defiant trespass on private property on Fairview Street in Pottsville was sentenced to serve an additional 12 montnhs on probation, pay a fine of $100, and $50 to CJEA.Julio Medina Jr., 20, New York City, on a charge of possession of a small amount of marijuina in Pottsville was given credit for serving 17 days in the county prison and was released on probation for 30 days, pay $100 to SAE fund and $113 to Bethlehem Regional Lab.Michelle Lynn Davis, 37, Pottsville, possession of a controlled substance, placed on probation 12 months, pay $100 to SAE fund, and$50 to CJEA. On a charge of retail theft from Turkey HIll Mini Mart in Schuylkill Haven, fined $100.Benjamin Garret Dutcavich, 19, Schuylkill Haven, DUI, served 48 hours in the county prison and released on parole for six months after serving his minimum time, pay a fine of $500, pay $100 to SAE fund, $50 to Catastrophe fund, enroll in a chemical dependency program, pay $60 to Schuylkill Medical Center and license suspended 12 months.Nicole Marie Elsdon, 27, Schuylkill Haven, retail theft from Redner's Market, North Manheim Township, placed on probation 12 months, pay a fine of $150, pay $50 to CJEA and perform 20 hours of community service.Kenneth Zachary Frie, 47, Pottsville, criminal conspiracy to commit theft at Walmart Store, Saint Clair, placed on probation 12 months, pay a fine of $150, pay $50 to CJEA and perform 10 hours community service.Lisa A. Keller, 42, Schuylkill Haven, disorderly conduct, fined $300 and pay $50 to CJEA.Joseph James Kriner, 32, Schuylkill Haven, possession of drug parapahernalia, placed on probation 12 months, pay a fine of $150, pay $100 to SAE fund, $50 to CJEA and make restitutilon of $176 to Bethlehem Regional Lab.Megan Alyssa Leymeister, 25, Schuylkill Haven, retail theft from Giant Food Market, North Manheim Township, pay a fine of $50 and pay $50 to CJEA.Donald L. Pryor, Philadelphia, terroristic threats to a student at the Schuylkill Campus of Penn State University in North Manheim Township, received credit for serving 68 days in the county prison and was released on parole for 23 months, fined $150 and costs, and pay $50 to CJEA. On a charge of giving police a false identification received a 12 months probation sentence to run concurrent with the other sentence, pay a fine of $150, and pay $50 to CJEA.Michael Paul Mason Jr., 38, Schuylkill Haven, possession of drug paraphernalia, received credit for serving 41 days in the county prison and was released on parole for 12 months, pay a fine of $150, $50 to CJEA, and $100 to SAE fund.Scott Allen Reed Jr., 25, Orwigsburg, DUI, served 72 hours in the county prison beginning last Friday at 7 p.m., and when completed his minimum was to be released on parole for six months, pay a fine of $1,000, $300 to SAE fund, $50 to Catastrophe fund, make restitution of $60 to Schuylkill Medical Center and $1,697 to Holly Motley and undergo substance abuse outpatient counseling. On charge of operating a vehicle after his license was suspended was fined $100, failing to drive at a safe speed, fined $25 and failing to wear a seat belt, fined $10 and pay $150 in costs. His driver's license is suspended 12 months.Aaron Anthony Torres, 19, Reading, possession of a small amount of marijuana in Schuylkill Haven, placed on probation 30 days, pay a fine of $150, $100 to SAE fund, $50 to CJEA and make restitution of $113 to Bethlehem Regional Lab.Samantha M. Vaughan, 39, Port Carbon, delivery of a controlled substance from her home, was given credit for serving 12 days in the county prison and was placed on probation for 23 months, pay a fine of $100, $100 to SAE fund, $50 to CJEA, make restitution of $113 to Bethlehem Regional Lab and $50 to Schuylkill County Drug Task Force.Each defendant must also pay court costs and a $50 per month supervision fee while on probation or parole.
