Breach of contract

Eagle Rock Community Association Inc., Hazleton, which operates the Eagle Rock Resorts in East and North Union townships, filed a civil action against Carl K. and Linda S. Fahnestoch, of 1188 North Colebrook Road, Manheim, who own Lot 225, Plat WSS, Eagle Resorts, Valley of Lakes, East Union Township, alleging they breached a contract by failing to keep up maintenance payments on their property. A judgement for $1,418 plus costs is sought.SentencedCraig A. Morgan, 44, Ashland, was placed by Judge John E. Domalakes in a probation program on a charge of indecent assauilt on a person under 13 years of age. The program is for 36 months. Morgan was also ordered to pay $50 to the Criminal Justice Enhancement Account, pay a $50 monthly supervision fee, pay court costs and he must register as a sex offender under Megan's Law for 10 years and follow all conditions of a sexual offender and absolutely have no contact with the victim. Morgan was cited by Chief Adam Bernodin Jr., Ashland Police, in July 2008.Revoke probationSeini Nancy Gustitus. 24, Lancaster, had her probation revoked because she failed to notify her probation officer within 48 hours of a new arrest on a charge of possession of illegal drugs and was re-sentenced by Judge D. Michael Stine to serve six to 12 months in the county prison with credit for 30 days. She had been placed on probation last November on charges of possession of a controlled substance and drug paraphernalia when cited by Patrolman Eugene M. Yourey, Pottsville police,Daniel Lee Walton, 35, West Reading, had his parole revoked for failling to report a new arrest and Stine recommitted him to the county prison to serve the balance of his sentence and his new maximum date for release was extended to Jan. 14, 2011. Walton was sentenced in November 2008 on charges of harassment and terroistic threats brougfht by Patrolman Daniel Weikel, Frackville police. He had served 127 days in prison.Jenine Barry, also known as Jenine L. Miller, 34, Girardville, had her probation revoked by President Judge William E. Baldwin and she was re-sentenced to serve three to 23 months in the county prison with credit for eight days served in prison. She had pleaded guilty to forging a physician's prescription to obtain additional drugs.Bail hearingRaymond Geary Hower, 20, Morea, Mahanoy Township, appeared in court on a bench warrant issued last April 28 and after a hearing Judge Stine vacated the bench warrant and bail forfeiture was set aside. New baill was set at $5,000 cash. Hower was also ordered to seek gainful employment and cannot consume, possess or transport any alcohol or drugs.Hower faces charges of making false reports to police incriminating another person. He had been placed in the Accelerated Rehabilative Disposition (ARD) program which is granted first offenders to work off their criminal record but it was revoked because he violated terms fixed by the court.
