Schuylkill inmate sentenced for assault on prison nurse

A prisoner in the state correctional institution in Ryan Township who entered a guilty plea to sexually assaulting a nurse in the prison was sentenced Friday in the Schuylkill County Court by Judge John E. Domalakes.

Milbert Cox, 35, was sentenced on a charge of aggravated indecent assault to serve 300 months nor more than life in a state correctional facility and aggravated harassment by a prisoner, 42 months to 84 months and indecent exposure, 12 months to 24 months, with both sentences to run concurrent with the first sentence.The sentences are to commence at the expiration of two long-term sentences imposed by the Philadelphia County Court for which he was serving in the prison located in Schuylkill County. The incident in the prison in Ryan Township occurred on Nov. 19, 2007.Judge Cyrus Palmer Dolbin accepted the guilty plea recently of Mahanoy Township man and imposed the following sentence:Michael P. Whitaker, Morea Road, Mahanoy Township, on a charge of driving under the influence of alcohol was placed in the IPP (Intermediate Punishment Program) for five years to serve the first three months in the Schuylkill County Prison beginning Friday, December 18 at 10 a.m., followed by nine months of home confinement under electronic monitoring at pay a $12 daily fee, and the balance of his sentence under regular probation and pay a $50 monthly fee for each month on probation.Whitaker also must pay a fine of $1,500 and court costs, $300 to the SAE (Substance Abuse Education) fund, $50 to the CJEA (Criminal Justice Enhancement Account) fund and $50 to the Catastrophe fund, attend an alcohol highway safe driving school and receive outpatient counseling and his driver's license is suspended 18 months.Whitaker was cited by Patrolman Michael Dissinger, Mahanoy City Police, on April 26, 2008.Three who entered guilty pleas recently before President Judge William E. Baldwin included:• Eric Shaun Guscott, 21, of Pottsville, pleaded guilty to possession with intent and delivery of a controlled substance, illegal use of a cell phone and possession of drug paraphernalia, and was sentenced to serve six to 23 months in the county prison, pay $150 to the CJEA fund, $100 to the SAE fund, a $50 monthly probation fee, court costs and make restitution of $150 to the Pottsville Police Drug Task Force and $113 to Bethlehem Regional lab.• Kodie Allen Defour, 20, Schuylkill Haven, on a charge of theft by unlawful taking was placed on probation 12 months, pay a $50 monthly probation fee, pay $50 to CJEA fund and court costs and make restitution of $283.56 to Sovereign Bank, Pottsville. Defour was cited by Patrolman Kirk Becker, Pottsville Police, last May 15.• Joel Cossari, 36, Reading, Berks County, on a charge of striking a parked car and failing to stop, was placed on probation 12 months pay $50 to CJEA fund and make restitution of $6,520.38 to victim. Cossari was cited by Trooper Michael V. Ryan last March following a collision on Route 61 in North Manheim Township. He also was ordered to pay fines of $25 each plus costs totaling $150 for failing to notify police of the accident, failing to drive at a safe speed and careless driving.
