Lehighton man gets more state prison time

A Lehighton man, sentenced Tuesday in Carbon County court to a state prison term for drunken driving, was given more state prison time Thursday after pleading guilty to new criminal charges.

Gerald Vincent Niehoff was sentenced by Judge Steven R. Serfass to serve three to 24 months in a state correctional institution on counts of criminal mischief and escape, consecutive to the earlier sentence.On Tuesday President Judge Roger N. Nanovic sentenced Niehoff to serve 9 to 18 months in a state prison on a DUI charge.Niehoff was arrested on June 10 by Lehighton police for incidents in the area of 49 Lentz Ave. Police responded to the area to a report of an out-of-control man. On scene police found that Niehoff had damaged a parked vehicle in front of the residence. He was inside the home when officers arrived. They entered the home and told him he was under arrest. He fled but was later apprehended.Niehoff told Serfass he was high on drugs at the time and said he thought there were people in the car he damaged that were after him and that is why he broke windows and caused other damages. The vehicle, a 2014 Chevrolet Malibu, was a rental owned by Brodheadsville Chevrolet.Niehoff told Serfass, "I take full responsibility for my actions. I did well for nine months but relapsed. I just got out of control."Defense attorney Paul Levy, of the public defender's office, asked Serfass to imposed a sentence that would run concurrent with the one imposed by Nanovic. Serfass rejected that request, stating, "This was a very serious situation." He added he could not ignore the underlying facts of the case.In addition to the prison term, Serfass ordered Niehoff to perform a total of 200 hours of community service when paroled, zero tolerance imposed on drug and alcohol use, and pay court costs of about $1,000.
