Thirteen drunken driving defendants enter guilty pleas

A total of 13 defendants in pending driving under the influence cases entered guilty pleas in Carbon County court on Monday.

President Judge Roger N. Nanovic II accepted the pleas from the following:Sean Michael Kutz, 37, of Jim Thorpe, was arrested on Aug. 23, 2014, by state police at Lehighton along Fairyland Road in Franklin Township. Given a test, the result showed the presence of a controlled substance.Kutz also pleaded to one count of endangering the welfare of children. At the time of the stop Kutz had two children in the vehicle and one was not in a child safety seat as required, the police report stated.Nanovic deferred sentencing to a later date.Jessica Lindsay Hartman, 25, of Lehighton, was arrested on May 10, 2014, by state police at Lehighton along Route 248 in Franklin Township. Given a test, the result showed the presence of a controlled substance.Sentencing was deferred so Hartman could obtain a comprehensive drug and alcohol assessment.Lee B. Kester, 33, of Palmerton, was arrested on May 18, 2013, along Park Lane by Palmerton police. Given a test, the result showed the presence of a controlled substance.Sentencing was deferred.Sean H. Moore, 32, of Blakeslee, was arrested on Aug. 26, 2014, along East Street by Lehighton police. Given a test, the result showed alcohol content of 0.03 percent and also the presence of a controlled substance.A first offense, Moore was placed on probation for six months and ordered to pay a fine of $300, court costs of about $1,500, and a $50 per month supervision fee while on probation.Michael G. Galade, 38, of Lehighton, was arrested on Dec. 31, 2013, by state police at Lehighton along Bankway in Lehighton. Given a test, the result was 0.08BAC.Sentencing was deferred so Galade could obtain a comprehensive D&A assessment.Rachael Lauren Keller, 29, of Albrightsville, was arrested on Jan. 6, 2014, along Route 903 in Penn Forest Township by state police at Lehighton. Given a test, the result showed the presence of a controlled substance.Sentencing was deferred so she could obtain a D&A evaluation.Amber Lynn Tandy, 25, of Jim Thorpe, was arrested on May 21, 2014, along Route 903 in Jim Thorpe by state police at Lehighton. Given a test, the result showed the presence of a controlled substance.Sentencing was deferred so she could get a D&A evaluation.Sarah Elsayed, 24, of Effort, was arrested on March 30, 2014, along Route 209 in Towamensing Township by state police at Lehighton. Given a test, the result was 0.24BAC.Sentencing was deferred so she could obtain a comprehensive D&A assessment.Jason M. Smith, 37, of Lehighton, was arrested on Aug. 30, 2013, along Union Hill Road in Franklin Township by state police at Lehighton. Given a test, the result showed the presence of a controlled substance.Sentencing was deferred so he could get a D&A evaluation.Russell K. Balogach, 24, of Lehighton, was arrested on Sept. 7, 2014, along Constitution Avenue by Lehighton police. Given a test, the result was 0.16BAC.Sentencing was deferred.Wendy Heiney, 58, of Walnutport, was arrested on June 17, 2014, along Delaware Avenue by Palmerton police. Given a test, the result was 0.28BAC.Sentencing was deferred so she could get a comprehensive D&A assessment.Kevin James Marion, 49, of Upper Darby, Delaware County, was arrested on Aug. 17, 2014, along Route 209 by Franklin Township police. Given a test, the result was 0.19BAC.Sentencing was deferred so he could get a comprehensive D&A assessment.David Allen Christman, 28, of Palmerton, was arrested on July 6, 2014, by state police at Lehighton along Route 248 in Franklin Township. Given a test, the result showed the presence of a controlled substance.Sentencing was deferred so he could get a comprehensive D&A assessment.A recent state Supreme Court ruling mandates a defendant must have an initial D&A evaluation and, if recommended, a comprehensive D&A assessment before a court can impose a sentence.
