Suit filed against tattoo parlor

A civil complaint has been filed by 11 Lehighton residents against a tattoo parlor in the borough.

The suit, filed in the county court lists the following plaintiffs: Stephanie and Eamon Murray, Margaret E. Bayer, Marie Keegan, Robert D. and Diane L. Exner, Jason Nothstein, Ron and Jennifer Kusse, Diane Sample and Todd Kriner.The suit states all the plaintiffs own and/or rents real property within a three-block radius of the subject property, 336 Iron St.According to the suit on March 7 Joeleen Souders, of 205 Avenue A, Palmerton, applied for a permit for a tattoo parlor at 336 Iron St., called "Fresh Til Death."The suit further states that the Lehighton zoning officer issued a permit to operate the tattoo parlor in a residential area.The suit alleges the permit is not in compliance with the Lehighton Zoning Ordinance. It further alleges the ordinance does not provide for the operation of a tattoo parlor in a R-2 Residential District.The suit goes on to list reasons why the permit is not legal.The suit also charges, "The defendants continuing conduct deprives the Borough of Lehighton and its citizens rights to which they are entitled by operation of law which are not addressable by damages."The two-count suit asks the court to issue a rule to show cause why a preliminary injunction should not be granted against the defendant; that, after a hearing, a preliminary injunction order be issued; and a permanent injunction against the defendants be issued prohibiting the operation of a tattoo parlor and piercing shop at the subject site.The action was filed by the Sebelin Law Offices of Lehighton.
