Thomas Joseph Devitt, 22, of 22 W. Catawissa St., Nesquehoning, is facing drug-related charges stemming from an incident at 1:36 a.m. Aug. 22 in the borough.
Police said he is charged with two counts of possession of a controlled substance and one count of possession of drug paraphernalia.
Police said they found Devitt in an apparent unconscious state sitting behind the wheel of a vehicle on West Catawissa Street. At the time, police said, he was clutching a large glass smoking pipe, or bong, in both hands as the bottom of the pipe sat on the seat between his legs. Police said a small container of what appeared to be a dried vegetable matter was also recovered. Police also smelled a strong odor that was similar to burned marijuana.
Police said Devitt admitted he was smoking "incense." Testing on the substances revealed they were XLR 11 and AKB 48, which are schedule one substances, also known as synthetic marijuana.
