Immigration lawyer explains detention process

An Easton-based immigration lawyer said Thursday the American Immigration Lawyers Association is trying to schedule a video conference with three illegal immigrants detained Wednesday in Palmerton.

A sexual assault investigation led to the arrest of five undocumented immigrants Wednesday in Palmerton borough.Two of the men, Jose Antonio Corripio Martinez, 36, of Jim Thorpe, and Rafael Alberto Escobar Garcia, 29, of Palmerton, were charged for the sexual assault, which police said occurred at a party in mid-December.Three of their also undocumented co-workers were subsequently arrested.Specific information on the three people is scarce, attorney William Menard said, but it is likely they were taken to a detention center in York."We're still trying to find out more about their situation," Menard said. "At this point we don't know what they told Immigration and Customs Enforcement, if they had any family members here who are United States citizens, if they were in fact green card holders or if they had a previous deportation order."The case was so fresh for Menard, he and the association were still working on obtaining the names and any criminal background for the men.When immigrants are picked up by ICE, he added, processing can take a while."By next week we hope to have a lot more information," Menard added.Although they were detained for being in the country illegally, the men may have the opportunity to post a bond.Menard said that would be determined by their "danger to the community and risk of flight.""A lot of times if they have family members here legally, which makes them less likely to flee, and no criminal background, they would be eligible for a bond," he added."Recently though, the bonds have been higher. It was a couple thousand but it has been going up to about $15,000 to $20,000."A judge will be assigned to the case, but the location of proceedings is unknown."There is a court in the York detention center," Menard said, "but if they are bonded out it would most likely be transferred to Philadelphia."ICE officials had no further comment Thursday on the matter.
