Eighteen enter guilty pleas

Eighteen defendants in pending cases entered guilty pleas on Tuesday in Carbon County court.

Judge Joseph J. Matika accepted the pleas.BowmanstownincidentJames Leroy Luckenbaugh III, 27, of Lehighton, pleaded to one count each of terroristic threats, indecent exposure and institutional vandalism. A burglary charge was dropped in a plea bargain.Luckenbaugh was arrested by state police at Lehighton on Sept. 5, 2011, for incident at a residence along Fireline Road in Bowmanstown.According to troopers Luckenbaugh came to the home and forced his way in and threatened Charles Barlosky.After being taken into custody and transported to the state police barracks in Towamensing Township, Luckenbaugh urinated on a floor in the barracks and caused damage to furniture in the building.Matika noted that Luckenbaugh has an extensive prior criminal record and warned him each time he gets a conviction he faces long prison terms.On the threats count Matika sentenced him to serve nine to 24 months in a state prison and the same term on the indecent exposure charge. On the vandalism count he was sentenced to serve one to 12 months in a state prison. The terms all run concurrent. He was also ordered to have no contact with the victim, render 50 hours of community service when released on parole, and make restitution of $250 for damages at the barracks. He was given credit for 296 days spent in jail on the charges.Other pleasOther pleas accepted by Matika included:William James Wilkinson, 42, of Junedale, pleaded to one count of recklessly endangering another person. He was arrested on April 3, by state police at Hazleton for an incident at his residence with wife, Denisyn Wilkinson the victim.Troopers said he shot a bullet into the front tire driver's side of his wife's car. Wilkinson told Matika that he didn't want his wife to leave the residence and drive because he had been drinking alcohol.Matika said it was a "stupid" and "dangerous" thing to do.He was placed on probation for a year and ordered to render 50 hours of community service. He also must not have in his possession on at his residence any firearms during the period.Thomas Edward Leshko, 32, of Tamaqua R.D., pleaded to one count of false reports of an offense that didn't occurr.He was charged by state police at Hazleton with reporting a trailer he had at a business in Banks Township, had been stolen when, in fact, it had not been taken. He was planning to make a claim for damages from his insurance company.Leshko was placed on probation for a year and ordered to render 50 hours of community service. The sentence runs concurrent with a probation term he is currently serving in Schuylkill County.George Willis Shipps, 41, of Beaver Meadows, pleaded guilty to one count of false reports. He was involved in the incident with Leshko and reportedly was going to back up Leshko's story about the theft of the trailer.He was placed on probation for a year and ordered to render 50 hours of community service.Justin Hill, 21, of Lansford, pleaded to one count of driving under the influence (DUI). He was arrested on May 6, 2011, along Bertsch St., in Lansford. Given a test, the result showed the presence of a controlled substance in his system.Matika sentenced him to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension, get a drug and alcohol (D&A) evaluation and follow any recommendation for treatment, render 25 hours of community service, and zero tolerance imposed on D&A use.He will begin the jail term at 10 a.m. on Friday, June, 29.Patrick J. Kelly, 26, of Lansford, pleaded in two pending cases. He pleaded to one count of harassment, as a summary offense, for an incident on April 24 in Lansford in which his mother, Susan Kelly, was the victim. A simple assault charge was dropped in a plea bargain.He also pleaded to one count of endangering the welfare of a child for an incident on April 6 in the 200 block of E. Kline Ave. Police said he was riding a motorcycle with his one-year-old child sitting in his lap.Matika deferred sentencing and ordered Kelly to get a mental health evaluation. Kelly is currently in the county jail on the charges and is awaiting a probatoin violation proceeding filed by the adult probation office.Michael John McFadden, 24, of Nesquehoning, pleaded to one count each of theft from a motor vehicle and possession of a controlled substance. He was arrested on March 29 by Nesquehoning police for entering the vehicle of John Orsulak, along E. Catawissa St., and removing items. He was spotted by a neighbor. When police went to his home to arrest him they found illegal drugs.On the theft count Matika sentenced him to time served (73 days) to 18 months in jail. The same sentence was imposed on the possession count to run concurrent. He was also ordered to get a D&A evaluation, zero tolerance imposed on D&A use, render 75 hours of community service, and make restitution of $145 to the victim.Anthony Pelligrino, 33, of Kresgeville, pleaded to one count of forgery. He was arrested by state police at Lehighton, for taking the credit card of Michelle L. Profit, of Towamensing Township, and using it to make purchases.He was placed on probation for a year and ordered to make restitution of $84.38, and render 50 hours of community service.Andy William Gonzales-Silva, 18, of York, pleaded to one count of escape, as a felony. He was arrested by state police at Lehighton, for leaving the Youth Services Camp Adams, in Penn Forest Township, without permission on Dec. 1, 2011.Matika sentenced him to serve 90 days to one year in jail, supply a DNA sample and pay the $250 fee, and render 50 hours of community service. He was given credit for 208 days spent in jail on the charge and paroled.Christopher M. Schaeffer, 39, of Palmerton, pleaded to two counts of simple assault. He was arrested by Pamlerton police for an incident at a residence along Avenue A, in which Cynthia Weiss, his girlfriend, was the listed victim.Matika sentenced him to time served (five days) to one year in jail and ordered he get a D&A evaluation, zero tolerance imposed on D&A use, render 50 hours of community service, and attend and complete anger management counseling.Mattaus Sebastian Lagler, 22, of Allentown, pleaded to one count of DUI. He was arrested on Nov. 5, 2011, along the turnpike in East Penn Township after being stopped for speeding. Given a test, the result was .19BAC.Matika sentenced him to serve five days to six months in jail, a fine of $300, one year license suspension, get a D&A evaluation, and render 50 hours of community service. He began the jail term at 5 p.m.Troy Allen Refsnider, 41, of Nesquehoning, pleaded to one count of DUI, a first offense. He was arrested on Sept. 23, 2011, along Logger Road in Nesquehoning. Given a test, the result was .26BAC.He was placed on probation for six months and ordered to get a D&A evaluation, zero tolerance on D&A use, and render 50 hours of community service.Anthony Buskirk, 23, of Lansford, pleaded to one count each of persistent disorderly conduct and criminal mischief. He was arrested on April 25 by Lansford police for an incident at his residence.On the conduct charge he was placed on probation for a year and ordered to get a D&A evaluation, zero tolerance on D&A use, and render 50 hours of community service. On the mischief count he was fined $100.Wayne Allen Smith Jr., 24, of Palmerton, pleaded to one count of illegal sales of fireworks. He was arrested by borough police at his residence on July 4, 2011.He was placed on probation for six months and ordered to render 25 hours of community service.Stephanie Michelle Forrester, 20, of Coaldale, pleaded to one count of defiant trespass. She was arrested on March 12 in the area of 301 Lansford Court, Summit Hill, for being at the townhouse complex after previously being told she was not allowed on the property.Matika placed her on probation for six months and order her to render 25 hours of community service, and to stay off the townhouse property.Jason S. Oruska, 24, of Schnecksville, pleaded to one count of DUI. He was arrested on Nov. 13, 2011, along SR895 in East Penn Township by state police at Lehighton. Given a test, the result showed the presence of a controlled substance.Matika sentenced him to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension, get a D&A evaluation, and render 25 hours of community service. He was given credit for one day spent in jail on the charge.He begins the jail term at 6 p.m. on Friday, June 29.Michael G. Molnar, 27, of Weatherly, pleaded to one count of disorderly conduct, as a summary offense. He was arrested on Jan. 17 along Hudsondale St., by Weatherly police following a traffic stop. The conduct charge was added to an amended complaint while a drug possession charge was dropped.He was fined $100.Carmine Simeone, 35, of Tobyhanna, pleaded to one count of disorderly conduct, as a summary offense. He was arrested on Jan. 10 by Summit Hill police for an incident at a residence along W. Ludlow St.He was fined $100.Each defendant sentenced must also pay court costs, which average close to $1,000, and pay a $50 per month supervision fee while on probation or parole.
