Schuylkill County Court

In rulings issued April 18, Schuylkill County President Judge William E. Baldwin sentenced two defendants to Intermediate Punishment and sent one to County Prison:

Patrick N. DeCaprio

, 37, Ashley, was arrested by Rush Township Police officer Bradley Hess on March 18, 2018, and charged with DUI/General Impairment and DUI/Highest Rate. DeCaprio will serve six months Intermediate Punishment, which includes 25 days on house arrest with electronic surveillance, followed by 35 days strict supervision and four months on probation.

He must pay the costs of prosecution, including $120 to Lehigh Valley Health Network, a $300 fine, $100 to the substance abuse education fund, $150 to the MCARE fund and a $50 a month supervision fee.

DeCaprio must complete the DUI/Alcohol Highway Safety School, attend and complete outpatient treatment, undergo a 12-month license suspension followed by a 12-month ignition interlock, and perform 20 hours of community service.

Kimberly A. Bailey

, 46, Tamaqua was arrested Aug. 5, 2016, by West Penn Township Police officer Harry Brown and charged with DUI/General Impairment. She will be on Intermediate Punishment for six months, serving the first 15 days on house arrest followed by 45 days strict supervision and four months on probation.

She must pay a $300 fine, $100 to SAEF, $75 to MCARE and a $50 a month supervision fee. She must complete the DUI/Alcohol Highway Safety School, attend and complete outpatient treatment and perform 10 hours community service.

On related charges from the same incident she was placed on probation for two years for resisting arrest and for one year for disorderly conduct. On a careless driving charge, she must pay an additional $300 fine, plus $77 in fees, plus a $50 fine for restrictions on alcoholic beverages. A charge of fleeing or attempting to elude a police officer was dropped.

Michael V. Putalavage

, 66, Port Carbon, was arrested by Rush Township Police officer Bradley Hess on July 3, 2018, and charged with intentional possession of a controlled substance by a person not registered, and use/possession of drug paraphernalia. Putalavage was sentenced to Schuylkill County Prison for six to 23 months. He must also pay state lab fees of $176, $50 to the CJEA, and $100 to the SAEF.
