Schuylkill County Court

It was a day of waived cases in the court of District Judge Stephen Bayer of Tamaqua last week. With the exception of three defendants who had their cases withdrawn, all of the scheduled defendants elected to have their day in court held at the county level.

Joseph Scoggins, 23, of 205 E. Ridge St., Coaldale, had two cases scheduled before the magistrate. Both were related to domestic assaults, one on June 9 and the other on June 13. In the first case, Coaldale patrolman Joseph David filed charges of simple assault and harassment. Charges in the second case were filed by Coaldale patrolman Joseph Krebs and included making terroristic threats, simple assault and harassment.Scoggins remains in the Schuylkill County prison in Pottsville in lieu of $25,000 bail set in the second case. Bail in the first case was set at $10,000 unsecured.Alexander Riotto, 33, of Barnesville, also remains in the county prison after waiving his preliminary hearing.He was charged with criminal trespass, making terroristic threats, simple assault, harassment, disorderly conduct and open lewdness after he attempted to break into a neighbor's home on June 29. The charges were filed by Rush Township patrolman Thomas Fort.His bail was set at $25,000 straight cash.Michael R. Zuber, 29, of 2 E. Ridge St., Lansford, is the third defendant scheduled for a hearing that remains lodged in the county prison.Zuber was arrested on June 8 after assaulting an emergency medical technician while being transported to St. Luke's Hospital - Miners Campus in Coaldale. He continued to be unruly at the hospital, picking up a trauma stretcher and dropping it to the floor, breaking it. Charges of criminal mischief, disorderly conduct, resisting arrest and public drunkenness were filed by Coaldale patrolman Joseph Anthony.His bail was set at $10,000 straight cash.Other casesJuanita Black, 53, of Philadelphia waived a hearing on charges of fraudulently altering a vehicle title, driving without insurance, driving an unregistered vehicle, driving with a suspended registration and failure to carry a valid registration. The charges were filed by Rush Township patrolman Lucas Fox after a June 29 incident.Black was released on her own recognizance.Arthur Willie McMahon, 26, of Manchester, New Jersey, was scheduled for a hearing on charges of open lewdness and public drunkenness. The charges were filed by Tamaqua Police Chief Richard Weaver after McMahon was found wandering in the 100 block of Race Street on May 12. The defendant was totally nude at the time.He was released on his own recognizance.Lauren J. Ritchie, 39, of Coaldale waived a hearing on charges of simple assault, harassment and disorderly conduct. The charges stem from a June 26 incident and were filed by Tamaqua patrolman Anthony Stanell.Ritchie was released on her own recognizance.Tina M. Miller, 52, of Tamaqua, was charged with possession of a controlled substance, possession of drug paraphernalia, failure to stop and driving with a suspended/revoked license. The charges were filed by Tamaqua patrolwoman Jennifer Dempsey after a July 6 incident.Miller was released on her own recognizance.Charles N. Annis III, 33, of Madison, Virginia, waived a hearing on charges of possession of marijuana and possession of drug paraphernalia, filed by McAdoo patrolman William Curilla after an April 16 incident.Annis was released on his own recognizance.Matthew James Curvey, 28, of Brockton, was scheduled for a hearing on charges of possession of drug paraphernalia, operating a vehicle without a valid inspection and driving with a suspended/revoked license. The charges were filed by Tamaqua patrolman Matthew Houser after a Feb. 22 incident.Curvey was released on his own recognizance.Charges withdrawnDefendants who had charges against them withdrawn included: Gerald R. Fisher Jr. of McAdoo; Matthew Nace of Tamaqua; and Javier Rosario of Clifton, New Jersey.
