Prison Sentences

Kevin R. Scheitrum

, 62, Tamaqua, was arrested by state police trooper Leo Luciani July 28, 2017, and charged with DUI/general impairment and DUI/highest rate. On Feb. 27 Scheitrum withdrew a prior plea of not guilty and pleaded guilty to DUI/highest rate. The DUI/general impairment charge was dropped. He was sentenced to 72 hours to six months, to be granted immediate parole after serving the minimum sentence. He must pay a $1,000 fine and have driving privileges suspended for one year. He must also pay $120 to Lehigh Valley Health Network South, $70 to the MCARE fund, $300 to the substance abuse education fund and enroll in the LVHN highway safety school, plus two to three months in substance abuse outpatient treatment.

Nicholas J. D’Angelo

, 28, Pottsville, was arrested by Tamaqua police officer Thomas Rogers on Feb. 9, 2017, and charged with terroristic threats, disorderly conduct, harassment and criminal mischief. On March 4 D’Angelo was sentenced to one to 23 months, followed by three months on probation, for the terroristic threats charge. Since he had already served 146 days, he was immediately released. D’Angelo will be on probation for 12 months on the disorderly conduct charge.

John D. Bartholomew

, 28, Tamaqua, was arrested by state trooper Shawn Tray on July 12, 2018, and charged with four counts recklessly endangering another person and four counts harassment. On Feb. 22, Bartholomew was sentenced to time served to 23 months. Since he had already served the minimum sentence, he was released. He will be on probation for 23 months on the reckless endangerment charges. The harassment charges were dropped.

Robert C. Snell

, 35, Bernville, was arrested by Rush Township police officer Bradley Hess on Jan. 29, 2017, and charged with retail theft and receiving stolen property. On Feb. 22, Snell was sentenced to time served to 23 months on the retail theft charge. Since he had already served the minimum sentence, he was immediately released. He must pay restitution of $848. The receiving stolen property charge was dropped.

Jean A. Matweecha

, 60, McAdoo, was arrested by Rush Township police officer Ryan Oldt on Dec. 23, 2016, and charged with DUI. Matweecha withdrew a prior plea of not guilty and pleaded guilty on Feb. 28. She must pay $120 to Lehigh Valley Health Network, pay a $1,500 fine, pay $150 to MCARE, $300 to the substance abuse education fund and pay $50 to the Criminal Justice Enhancement Act. She was sentenced to 90 days to five years, with the sentence to be served on electronic monitoring beginning March 13. Matweecha must enroll in the alcohol highway safety school and successfully complete outpatient substance abuse treatment. She will undergo an 18-month license suspension followed by 12 months ignition lock, and serve 20 hours community service.

Nevin S. Holben

, 23, New Ringgold, was arrested by Rush Township police officer Michael Weaver on April 21, 2018, and charged with possession of a controlled substance by a person not registered. On Feb. 28, Holbert was sentenced to 15 days to 12 months, effective March 13. Holben must pay a $400 fine, $100 to the substance abuse education fund and a $50 bench warrant fee. After release he will be on probation for 12 months.

Daniel J. Schaller

, 40, Summit Hill, was arrested by Coaldale police officer Joseph David on July 19, 2014, and charged with DUI: General impairment, DUI: Highest rate, driving while operating privileges are suspended or revoked, not using low beams, disregard of traffic lane, failure to keep right and careless driving. On Feb. 28, Schaller withdrew a prior not guilty plea and pleaded guilty to counts 2, 3, 5 and 6; the DUI/general impairment, not using low beams and disregard of traffic lane charges were dropped. He was sentenced to 72 hours to six months. Schaller must also pay a $1,000 fine, $60 restitution to an injury party, $75 to MCARE, $50 to the criminal justice enhancement act, and related fines and fees totaling $581.

Todd M. Miller

, 25, Weatherly, was arrested March 17, 2017, by McAdoo police officer William Curilla and charged with DUI, possession of marijuana, use or possession of drug paraphernalia and improper sun screening. On Feb. 21, upon information received from the Adult Probation Department, Miller was sentenced to 30 days in prison with work release (if eligible) beginning April 15. The county jail sentence will be followed by four years and 11 months on intermediate punishment, as follows: 90 days on house arrest with electronic surveillance at a fee of $12 per day, 30 days on the SCRAM bracelet at $12 per day, four years on probation and seven months strict supervision. Miller must pay a $1,500 fine, $100 to the substance abuse education fund, $150 to MCARE. His license is suspended for 18 months, followed by 12 months ignition lock. He must do 20 hours community service. The possession charges and the improper sun screening charges were dropped.

Parole Revoked

Sarah A. Bensinger

, 27, Tamaqua, was arrested by Tamaqua police officer Michael Hobbs on Feb. 15, 2017, and charged with use or possession of drug paraphernalia. On Feb. 27 her parole was revoked due to violation of conditions of parole. Bensinger was committed to Schuylkill County Prison to serve her original sentence with a loss of liberty of 192 days (May 29, 2018, to Dec. 6, 2018) with a new max date of Aug. 1.

Probation Revoked

Michelle M. Rex

, 44, Tamaqua, was arrested by Tamaqua police officer Anthony Stanell on Nov. 15, 2017, and charged with use or possession of drug paraphernalia. On March 5, the court found she had violated conditions of her probation and she was resentenced to serve three to 12 months, with credit for 42 days served from Jan. 23 to March 5. Her new parole max date is Jan. 23, 2020. She is eligible for re-parole April 23, if paroled into a drug/alcohol inpatient facility.

Probation Sentences

Mark W. Whilden

, 38, Coaldale, was arrested July 12, 2017, by Coaldale police officer Todd Weiss and charged with simple assault. On Feb. 28, Whilden was sentenced to 24 months on probation.

Samuel C. Smolar

, 29, Tamaqua, was arrested March 19, 2018, by Rush Township police officer Ryan Oldt and charged with possession of a controlled substance by a person not registered. On Feb. 28 Smolar was sentenced to 12 months on probation.

Michael T. Lyons

, 20, Hazleton, was arrested Feb. 18, 2018, by McAdoo police officer William Curilla and charged with possession of marijuana and possession of drug paraphernalia. On Feb. 28 Lyons was place of probation for 12 months on the possession of drug paraphernalia charge. The possession of marijuana charge was dropped.

Taryn Lee Depos

, 32, Tamaqua, was arrested Dec. 18, 2015, by Tamaqua police officer Karl Harig and charged with possession of a controlled substance by a person not registered. On Feb. 28 Depos was placed on probation for 12 months on the charge.

Carina E. Leach

, 21, Quakake, was arrested July 5, 2018, by Tamaqua police officer Anthony Stanell and charged with simple assault, harassment and use or possession of drug paraphernalia. On Feb. 28 she was placed on probation for 12 months on the use or possession of drug paraphernalia charge. The simple assault and harassment charges were dropped.
