PUBLIC NOTICE Pursuant to the Surface Mining Conservation and Reclamation Act, the Coal Refuse Disposal Control Act, the Clean Streams Law, and the Rules and Regulations of the Pennsylvania Department of Environmental Protection, Chapter 25, Section 86.54, notice is hereby given that BET Associates IV LLC, 1233 East Broad Street, Tamaqua, PA 18252, has made application to the Pennsylvania Department of Environmental Protection for renewal of its existing surface coal mining, coal preparation and coal refuse disposal permit and related NPDES Permit. The current permit No. 54733020 was originally issued on August 28, 1985. This renewal contains a minor revision to the existing operation consisting of a change in the bonded areas for Jobs 88, 99 and 111 and Bank 8. The operation is located in the boroughs of Tamaqua and Coaldale, Schuylkill County, and the boroughs of Lansford, Nesquehoning and Summit Hill, Carbon County. The permit area is 7,596.4 acres and is situated along both the northerly and southerly sides of Route 209 through the Panther Creek Valley. The receiving streams for the permit area are Slum Creek, Panther Creek and the Little Schuylkill River. Under the NPDES Permit PA0012360, there are three (3) new mine drainage treatment facility outfall points along Panther Creek. These points are identified as outfalls #001, #003 and #004. There is one (1) existing mine drainage treatment outfall point, #005, which discharges to the Little Schuylkill River. In addition to the mine drainage treatment facility outfalls, there are two (2) new stormwater outfall points identified as #002 and #006, which will allow stormwater discharge to Panther Creek. The Tamaqua PA U.S. Geological Survey 7.5 minute topographic map contains the area described. A copy of the application is available for public inspection at the Pennsylvania Department of Environmental Protection, Pottsville District Mining Office (See address below). Written comments, objections, or a request for public hearing or informal conference may be submitted to the Department of Environmental Protection, Pottsville District Mining Office, 5 West Laurel Boulevard, Pottsville, PA 17902 by February 27, 2019, and must include the person's name, address, telephone number, and a brief statement as to the nature of the objection(s).
