Prothonotary’s report

A total of 270 cases were started in April in the office of Carbon County Prothonotary Joann M. Behrens, according to a monthly statistical report released by the officeholder. A breakdown of cases is as follows:

Civil actions, 40; custody complaints, 22; complaints to modify custody, 21; district justice appeals, 4; declaratory judgment, 1; divorce complaints, 31; complaints in ejectment, 5; license appeals, 3; mandamus complaint, 1; mortgage foreclosure complaints, 23; name change petition, 1; protection from abuse petitions, 23; protection from abuse by sexually violent individual petition, 1; replevin complaint, 1; tax sales, 2; auditor/financial report, 1; court appointment, 1; judgments, 52; miscellaneous cases, 4; stipulations/waivers of liens, 3; and writs of executions, 30. The office also processed 138 applications for U.S. Passports and assisted the public with 51 applications for passport renewals.

Behrens’ financial report for April shows $34,308.71 was generated as follows: prothonotary’s fees, $28,791.11; interest income, $2.85; custody/divorce fees, $1,940; data processing fees, $3,534.75; stenographer fees; $40; and remote access fees, $1,800.

The prothonotary also remitted $6,098.43 to the Commonwealth of Pennsylvania, Department of Revenue, representing state fees collected locally, and $76.80 to the Administrative Offices of the Pennsylvania Courts, this being surcharges on new custody cases in accordance with Act 119 of 1996. Another $895 was deposited in the Prothonotary’s Automation Fund for future use in automating the office.

Revenue from deeds

Carbon County Recorder of Deeds Emmett P. McCall reported his office recorded 225 deeds, 177 mortgages and 330 other writs during the month of April.

As a result of those transactions, McCall turned over to the Carbon County General Fund the sum of $30,188.07. A breakdown of that revenue includes: transfer fees, $23,387.50; data processing fees, $1,798.01; notaries, $30; commission on transfers and writs, $3,829.56; and Affordable Housing administrative fee, $1,143.

McCall remitted $366 in state writ taxes to the Commonwealth of Pennsylvania Department of Revenue, while Carbon County municipalities and school districts shared realty transfer tax disbursements totaling $190,883.20, the same amount that was forwarded to the state in realty transfer taxes.

McCall deposited $2,211 in the Recorder of Deeds Record Improvement Fund and $1,474 in the Carbon County Records Improvement Fund, these being fees assessed by state law on each transaction for records management needs. An additional $26,645.50 was collected and remitted to the state for its Judicial Computer System program.

Also, $6,477 was collected last month for the Affordable Housing Program in Carbon County.

In all, funds collected in the Recorder’s office last month amounted to $449,127.97.
