Carbon County court

Two defendants who previously pleaded guilty to driving under the influence charges were sentenced on Tuesday afternoon in Carbon County court.

President Judge Roger N. Nanovic imposed sentences on:

John Hower Jr.

, 32, formerly of Lehighton and now of Wilkes-Barre, was sentenced to serve one to five years in the county prison. He was arrested on Aug. 22, 2016, by Lehighton police. A test revealed the presence of a controlled substance.

Hower told the court he spent 176 days in an inpatient rehabilitation program for his drug addiction run by the Salvation Army and is currently engaged in an outpatient counseling program.

He told Nanovic, “I’m getting back on my feet. I was using drugs when I was 16.” He said he moved to Wilkes-Barre to get away from the people who influenced him in the Lehighton area.

In addition to the jail term, Nanovic ordered Hower to pay a fine of $2,500 and his license was suspended for 18 months. On a charge of driving under suspension - DUI related, he was sentenced to serve 90 days in prison and pay a fine of $500. The prison terms run concurrently.

He was given credit for 237 days spent in rehab program and prison. He will begin serving the remainder of his time on Oct. 30 at 8 p.m. He was granted work-release privileges.

Thomas David Rosevear

, 44, of Stroudsburg, was sentenced to serve 90 days to 60 months in prison, pay a fine of $1,500 and his license was suspended for 18 months.

He was arrested on Sept. 2, 2017, by state police at Lehighton along Route 209 in Franklin Township. A test revealed the presence of a controlled substance.

He was given credit for 33 days spent in an inpatient rehab program and will begin serving the remainder of his sentence at 5 p.m. on Oct. 28.

Both were also ordered to follow any recommendation of their drug and alcohol evaluation.

Schuyler M. Drake

, 26, of Lafayette, New Jersey, was placed on probation for a year on a charge of institutional vandalism. In exchange for the plea, charges of resisting arrest and harassment were dropped.

Drake was arrested on May 5, 2018, when Kidder Township police were dispatched to the Big Boulder area for a domestic dispute. On scene Drake was identified by the female victim as the person involved.

When police took him into custody and placed him in a police cruiser, he damaged the interior and door of the cruiser. While at the police station, he put a hole in a wall in the holding cell.

At his plea hearing, Drake disputed the restitution for damages to the police cruiser, which were reported at over $5,000, but agreed to the damages to the holding cell, set at $850. Nanovic deferred sentencing at that time, ordering the district attorney’s office to investigate the restitution bill for the cruiser.

Assistant District Attorney Seth Miller said the DA’s office determined the correct restitution for damages is $2,598.15, which Drake agreed. Nanovic ordered that amount be paid to Kidder Township.

The three defendants must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole or probation.
