Carbon County court

A Carbon County man admitted to two thefts and one drug count on Monday in Carbon County court.

He was one of nine defendants in pending criminal cases to enter a guilty plea before Judge Joseph J. Matika.

Theft cases

Christopher Ohl

, 41, of Lehighton, pleaded to one count each of retail theft, theft and possession of drug paraphernalia. He admitted stealing merchandise from the Jim Thorpe Market on Dec. 24, 2015; involved in a theft in Nesquehoning on March 4, 2015; and found with the drug paraphernalia by Franklin Township police on June 6, 2017.

Ohl is currently an inmate in the county prison on the charges.

Matika placed him on probation for 18 months on all three counts, with the terms running concurrently, and ordered he render 75 hours of community service, get a drug and alcohol evaluation and follow any recommendation for treatment, zero tolerance for drug and alcohol use, make restitution to Jim Thorpe Market for $66.60 and have no contact with the victims in the thefts.

Other pleas

Stewart Allen Counterman Jr.

, 37, of Lehighton, pleaded to one count of simple assault. He was charged for an incident on Jan. 2, 2017, by Lansford police involving his ex-wife as the victim along West Abbott Street.

He was sentenced to serve three to 12 months in prison and ordered to get both drug and alcohol and mental health evaluations, attend and complete anger management counseling sessions, have no contact with the victim and when released on parole render 50 hours of community service.

He will begin the jail term at 9 a.m. on April 2. He was granted work-release privileges.

Megan Jean Luchetta

, 23, of McAdoo, pleaded to one count of defiant trespass. She was arrested on Feb. 2 by Summit Hill police for an incident in the borough involving a female victim.

She was placed on probation for a year and ordered to make restitution for damages of $437.50 (her share), render 50 hours of community service and have no contact with the victim.

Zoey Danielle Bartenope

, 20, of Palmerton, pleaded to one count of retail theft. She was arrested for an incident on April 15, 2017, at the Walmart store in Mahoning Township.

She is currently an inmate in the county prison facing a probation violation hearing. Sentencing was deferred.

Kelly Sue Smith

, 45, of Nesquehoning, pleaded to one count of resisting arrest. She was arrested on Dec. 20, 2017, by Nesquehoning police.

She is currently an inmate in the county prison on another pending case and also has a detainer filed against her by Schuylkill County authorities.

Matika placed her on probation for a year and ordered her to render 50 hours of community service when paroled, get a drug and alcohol evaluation and zero tolerance for drug and alcohol use.

Francis A. Carr III

, 29, of Freeland, Luzerne County, pleaded to one count of simple assault. A charge of terroristic threats was dropped in a plea bargain. He was arrested on Oct. 24, 2017, by Weatherly police for an incident involving a female on Eurana Avenue.

He is currently an inmate in the Luzerne County prison on a pending probation violation.

Matika placed him on probation for a year and ordered him to render 50 hours of community service when paroled, get a drug and alcohol evaluation, attend and successfully complete an anger management course and have no contact with the victim.

Mark Joseph Dacosta

, 36, of Lehighton, pleaded to one count each of theft and receiving stolen property. He was charged by Lehighton police for an incident on Oct. 15, 2015, in which an all-terrain vehicle and chain saw were stolen.

Dacosta also appeared to be sentenced on a charge of retail theft for an incident on Sept. 4, 2015, in Mahoning Township at the Walmart store in which he previously pleaded.

However, sentencing in both cases were deferred as Dacosta is applying for placement in the state’s Intermediate Punishment program. He was taken into custody and will be transferred to a state correctional institution for evaluation for the program.

If he is accepted he will serve two years in the program, if not, he will be brought back to Carbon for sentencing.

Lonnie Paul Rex

, 43, of Palmerton, pleaded to one count of unsworn falsification to authorities. He was arrested by Mahoning Township police for an incident on July 11, 2017.

He was placed on probation for a year and ordered to render 50 hours of community service.

Kelly Dugan

, 41, of Lansford, pleaded to one count of obstruction of the administration of law or other government function. She was arrested by Lansford police for an incident on Jan. 5 involving her ex-husband.

Matika placed her on probation for six months and ordered her to render 25 hours of community service.

Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation or parole.
