Palmerton Board to review carport request

A Palmerton man seeking permission to build a carport over his existing driveway in front of his home will appear before the borough's zoning hearing board at 7 p.m. Wednesday on his request.

Charles Pammer, of 819 Edgemont Ave., wants to construct the carport over his existing driveway in the front of his dwelling, and has proposed a 4-foot, 8-inch setback from the front yard.

In his rejection letter, dated Oct. 30, borough zoning officer Duane Dellecker noted that the property is located in an R-2 (Medium Density Residential) zoning district.

Dellecker wrote in his letter that Pammer has proposed to erect a 14-foot-by-18-foot, 9-inch carport to convert his existing driveway in front of his dwelling unit 4-foot, 8-inches from the front curb line along his property.

However, Dellecker said the zoning ordinance requires a front yard setback of 25-feet for any new structure in this zoning district.

Dellecker said the zoning ordinance requires setbacks be measured from the right-of-way of the street. Edgemont Avenue has a paved width of 30-feet, and a right-of-way width of 40-feet, Dellecker said.

Dellecker also said that the right-of-way of Edgemont Avenue extends 5-feet in from the curb line on each side of the street.

The ordinance says, "In no case shall an accessory building be located less than 5 feet from the right-of-way of a common or public alley, nor less than 10 feet from the right-of-way of a street. That means the ordinance requires an accessory building, such as a carport, be at least 10 feet from the right-of-way line of Edgemont Avenue.

"The application, as submitted, reflects a proposed setback of 4-feet, 8-inches from the front yard," Dellecker said. "This proposed setback would encroach on the street right-of-way by 4 inches, and not meet the setback requirement by an additional 10 feet."
