Two placed in probation program

Two persons facing criminal charges were placed in Carbon County's Accelerated Rehabilitation Disposition (ARD) probation program for first time offenders on Tuesday by Judge Steven R. Serfass.

If they successfully complete all conditions of the program their record will be wiped clean. However, if they fail to complete it or are revoked from it, they will face trial on all pending charges. A person does not admit guilt in entering the program.

Jenny Beers, 36, of Jim Thorpe, was placed for two years on a charge of fraud, obatining food stamps/assistance illegally. She was arrested by the state Department of Welfare for obtaining $9,888.20 in child care assistance while the father of the children resided in the home and was employed.

Serfass assessed the cost of the program at $450, and ordered her to repay the $9,888.20, and render 100 hours of community service.

Kelly L. Oakes, 24, of Oceanview, Del., was placed for a year on a charge of driving under the influence (DUI). She was arrested on March 18, 2012, along the turnpike in Penn Forest Township by state police at Pocono. Given a test, the result was .19BAC.

She was assessed $550, and ordered to get a drug and alcohol evaluation and follow any recommendation for treatment, license suspended for 60 days, and render 50 hours of community service.

Each defendant must also pay court costs, which average close fo $1,000, and pay a $50 per month supervision fee.
