Hearing continued for indecent assault suspect

Published March 27. 2013 05:02PM

A hearing for a Carbon County man charged with the indecent assault of a young girl has been continued.

Brian Kibler, 39, of Lehighton, was scheduled to have a preliminary hearing today before District Judge William Kissner of Palmerton.

But the hearing has been postponed. No new hearing date has yet to be established.

Kibler faces charges on two counts of indecent assault, and one count each of indecent exposure and corruption of minors.

He remains incarcerated in Carbon County Prison in lieu of $150,000 straight bail.

According to the affidavit of probable cause filed by Trooper Nicolas De La Iglesia of the Lehighton barracks.

The victim was a 10-11-year-old female known to Kibler at the time of the incident, according to the affidavit.

Sometime during 2011, when the victim was between 10 and 11 years of age, the victim came to Kibler's home in Franklin Township and spent the night, the affidavit says.

The victim related that Kibler had her dress in a thong and watch pornography with him. She further related that Kibler had her perform a sex act.

On Feb. 1, Kibler was interviewed at PSP Lehighton. The interview was non-custodial, and Kibler was aware that he was not under arrest.

Kibler confessed to trooper Pietkiewicz that the victim had performed the act. De La Iglesia was made aware of the confession, and entered the room.

De La Iglesia then requested that Kibler submit to an interview with him, and that the interview be consensually audio recorded. Kibler agreed, and provided a consensually recorded confession that the victim had performed the act for about one minute.

Kibler's account of the events in this incident mirrored the victim's account, except that he related the victim initiated this incident.
