Sexual assault charges waived to Carbon Court

Charges against a Palmerton man accused of sexually assaulting a young girl nearly a decade ago have been bound over for court.
Earl Scott, 53, was scheduled to have a preliminary hearing Wednesday before District Judge William Kissner of Palmerton. Scott faces three counts of indecent assault and one count of corruption of minors.
Scott waived his right to the hearing and will appear before the Carbon County Court of Common Pleas at 1:15 p.m. Aug. 15.
He remains free in lieu of $2,500 unsecured bail, and is to have no contact with the victim, or cause anyone else to have contact with the victim, or anyone else listed on the complaint.
According to an affidavit of probable cause filed by trooper Brian Silliman of the Pennsylvania State Police Criminal Investigation Unit at the Lehighton Station:
On June 10, Silliman was assigned to investigate a sexual assault incident which was reported to the Carbon County Children & Youth Services.
The victim reported that she was sexually assaulted at a residence located on Dairy Road in Lower Towamensing Township.
On June 11, Silliman interviewed the victim, who is currently 17. The victim said that between eight to nine years ago, she was visiting a relative at the home along Dairy Road. The victim said that the relative left, and she decided to visit Earl Scott and Linda Scott.
The victim said Earl Scott approached her and began rubbing her private area and breasts on top of her clothing. The victim said that they were standing in a room, and when another person entered the room, Scott stopped touching her.
The victim said that she told Scott to stop, but he continued to touch her until the other person arrived.
On June 17, Silliman arrived at the home on Dairy Road and spoke with Scott. At this time, Scott admitted that he recalled rubbing the victim on her private area and breasts, and knew what he was doing was inappropriate. Scott said that he only touched the victim on top of her clothes.
