Coaldale man charged with 3 counts of DUI
Coaldale police have charged a borough man with three counts of driving under the influence of alcohol or a controlled substance, and possession of a small amount of marijuana.
Michael J. Kabana, 22, of 15 W. Ruddle St., was charged on Oct. 20 by Officer Joseph Krebs.
According to an affidavit of probable cause, here's what happened:
Krebs was on patrol in the area of 4th and Ruddle streets at about 11:30 p.m. when he saw a silver Buick sedan, with its headlights on, parking. He continued his patrol, and at 11:54 p.m., was traveling west on Ruddle Street when he noticed the car was still running in the same spot. Krebs pulled behind the car, and saw that someone was slumped over the in the front seat.
He woke the driver and had him turn off the car. He then asked for the driver's documents. Krebs noticed the driver's mouth appeared dry, and that his pupils were constricted and his eyes glassy.
Krebs identified him by his license, but Kabana was unable to produce a registration or insurance card. Krebs asked him to exit the car for field sobriety tests, which Kabana failed.
Krebs arrested him for driving under the influence and took him to St. Luke's Miners Memorial Hospital for a blood draw. The tests revealed the presence of Clonazepam (a calming drug); Alprazolam (generic Xanax); Delta-9 THC and Delta-9 carboxy THC (both marijuana derivatives), and Oxycodone-free.
Kabana also had two small bags of marijuana in a cigarette box.
