Preliminary hearing held for sex assault suspect

A West Hazleton man accused of sexually assaulting a McAdoo girl was returned to the Schuylkill County Prison, Pottsville, following his preliminary hearing on Tuesday. The case against Roberto Acosta, 20, was bound over for criminal court trial following the hearing before District Judge Stephen Bayer, Tamaqua.

Acosta was charged with aggravated indecent assault, indecent assault, corruption of minors and indecent exposure following the Dec. 27 incident. The charges were filed by McAdoo Police Chief Jeffrey Wainwright.

A move to have Acosta's bail reduced from the original $50,000 straight cash bond was denied by Judge Bayer.

According to the affidavit of probable cause, Acosta approached the victim at a McAdoo Borough business, asking the girl to go to the basement storage area with him. When he persisted, the girl walked to the basement in an effort to stop the harassment. Once there, Acosta allegedly asked her to perform lewd acts, then exposed himself, threw her to the floor and began pulling at her clothes. After a struggle, she was able to free herself and ran upstairs for help.

The 17 year old victim was the only person to testify during the hearing.
