Schuylkill judge sentences man to time in state prison

A Pottsville man who pleaded guilty to driving under the influence of alcohol, possessing a controlled substance and being involved in an accident was sentenced to serve one to five years in a state corrrectional facility by President Judge Willliam E. Baldwin in the Schuylkill County Court.

The plea was entered by Robert Allen Shutt, Jr., 45, who was given credit for serving 168 days in the Schuylkill County Prison and one day in Lebanon County Prison. He also must pay $100 to the SAE (Substance Abuse Education) fund, $60 to Schuylkill Medical Center and make restitution of $5,204.63 to David Womer whose parked vehicle he damaged in a collision on Hotel Street, Pottsville, on September 21. 2010.

On a summary charge of driving while his operating privileges were suspended, he was fined $200 plus $50 costs. Shutt was cited by Patrolman Richard J. Pugh, Pottsville police. He also pleaded guilty to two additional charges of possession of a controlled substance and three counts of misbranding a controlled substance and was sentenced to serve six months to 12 months to run consecutive to his first sentence.

Shutt was cited by Patrolman Eugene M. Yourey, Pottsville police, on August 13, 2010.

Judge Baldwin also sentenced four other defendants who entered guilty pleas.

• Denise Marie Watkins, 43, Pottsville, on a DUI charge, was sentenced to serve 72 hours to six months in the county prison with the sentence to begin on Friday, Jan. 27 at 9 a.m. and on completion of her minimum sentence is to be released to serve the balance of her sentence on parole, fined $1,000, pay $300 to SAE fund, $60 to Schuylkill Medical Center, $50 to CJEA (Criminal Justice Enhancement Account) and a $50 monthly fee for each month on parole and submit to random screens.

Watkins was cited by Patrolman Charles B. Webber, Pottsville police, last Feb. 4.

• Jane Ellen Bruno, 45, Pottsville, on charges of three counts of forgery of a credit card and one count each of criminal conspiracy and theft, was placed on probation for 23 months, pay $50 to CJEA and a $50 monthly probation fee.

She was cited by Patrolman Joseph H. Murton, Pottsville Police, last March 17. Bruno also pleaded guilty to theft by failing to pay a cab fair from Chester to Pottsville and was given a concurrent 12 months probation sentence and pay $50 to CJEA.

She was cited by Sgt. John Morrow, Pottsville police, last March 15.

• Gary Lee Sherman, Jr., 34, Williamstown, on the summary charge of driving without a license in Tower City, was fined $200 and driving an unregistered car fined $75 plus $100 costs. He was cited by Patrolman John Boyer, Tower City police, on April 9, 2009.

• Garry Timberlake, 50, Pottsville, on a charge of defiant trespass in a private home, was placed on probation 12 months, pay $50 to CJEA. He was cited by Patrolman Eugene M. Yourey, Pottsville police, last Feb. 24. He also pleaded guilty to a second defiant trespass on private property and received a sentence to serve an additional 12 months on probation.

He was cited by Cpl. Francis B. Lynagh, Pottsville police, last Jan. 25. On a third count of defiant trespass on private property, he received a concurrent probation sentence. He was cited by Patrolman Paul R. Olson, Pottsville police, last June 17. Timberlake also must pay a $50 monthly probation fee.
