Lansford man charged with simple assault
David Kutz, 43, of 348 W. Kline Ave., Lansford, faces charges from an incident which took place on July 24 at 3:23 p.m. at that address. Charges were filed by borough Officer Brian Horos. Kutz is charged with simple assault and harassment.
According to an affidavit of probable cause, here's what happened:
Horos was dispatched to the address on an assault that had just taken place. Emergency medical services were also called to the scene.
Horos arrived to find the victim leaning up against a vehicle in front of the house. He asked her what had happened, and she told him that Kutz had kicked a large suitcase off the second floor porch, and it had struck her in the head and on the left shoulder.
She also pointed out a black mark on the car, and said it had hit it, too.
The ambulance arrived and the crew began to treat the victim's injuries. She was then taken by ambulance to St. Luke's Miners Memorial Hospital, Coaldale, for treatment of abrasions.
Horos went upstairs and asked Kutz what had happened. Kutz took Horos to the second story porch, and said he was sitting on an end table. He said he got up to go inside, but the suitcase, and the victim's daughter, were in the way. He said he kicked the suitcase and it went over the side of the porch and hit the victim.
