Tamaqua area man pleads to DUI, gets prison time

A Tamaqua area man was among six who recently entered guilty pleas in Schuylkill County court.

John M. McClain, 9 Lincoln Drive, Tamaqua R.D., pleaded guilty to driving under the influence (DUI) of alcohol and was sentenced by President Judge William E. Baldwin to serve five days to six months in the county prison, pay $100 to Substance Abuse Education (SAE) fund, $50 to Catastrophe fund, a fine of $300, and his driving privileges were suspended 12 months. On a charge of careless driving he was fined $25 plus $50 costs. McClain was cited by Mahanoy City Cpl. MIchael Dissinger.

Gary David Miller, 49, Schuylkill Haven, was removed by Judge Charles M. Miller from the state's Intermediate Punishment Program (IPP) and was sentenced to serve 42 to 84 months in a state correctional institution on charges of burglarizing the home of Marilyn and Delores Morgan, Schuylkill Haven, and theft of copper from USS Achey scrap yard in Schuylkill Haven. He received credit for serving 308 days in the program.

He also was ordered to pay $100 to Criminal Justice Enhancement Account (CJEA) and make restitution of $10,650 to the Morgans for copper removed from their home and $125.46 to the scrap yard owner.

Scott Charles Jones, 35, Pottsville, pleaded guilty to 16 criminal charges and Judge Baldwin deferred sentence to a later date. Glunz faces four counts each of aggravated and simple assault and recklessly endangering another person and two counts each fleeing police and criminal mischief filed by Pottsville Patrolman Brian J. Reno. Information filed to court claims four police officers were injured and $5,000 damage caused to a police cruiser.

Richard Formica, 49, Lancaster, pleaded guilty to two counts each of theft from motor vehicles in Cass Township, theft by unlawful taking and receiving stolen property and one count of criminal mischief. Sentence was deferred by Judge Baldwin to a later date. He was charged by Patrolman Danielle Jo Mowery, Cass/Foster Townships Police.

Jacob Daniel Souchak, 22, Mahanoy City, pleaded guilty to a charge of DUI and while his driver's license was suspended and his sentence was deferred by Judge Baldwin to a later date. Souchak was cited by Mahanoy City Patrolman ChristopherZubris.

David A. Willison, 38, Dauphin, pleaded guilty to DUI and was sentenced by Judge Baldwin to serve 72 hours to six months in the county prison, pay $300 to SAE fund, $50 each to CJEA and Catastrophe fund, and $60 to Schuylkill Medical Center.

On a charge of being involved in an accident with another vehicle on Greenwood Road in Porter Township received a concurrent 12 months probation sentence but must make restitution of $17,218.14 to Robert Snyder, the victim who was a passenger in his vehicle. On two summary charges, failing to drive on roadway laned for traffic and failing to use safety belt system was fined $50 plus $100 costs. Willson was cited by Trooper Thomas Hornung.
